(“OpenEvidence,” “we”, “us” or “our”) is an AI-powered clinical support platform designed for use by healthcare professionals (“you”) to access and analyze medical information that is sourced, cited, and grounded in evidence-based, peer-reviewed medical resources, including journals and research from leading medical societies, academic medical research centers and other healthcare partners. OpenEvidence is intended to inform—not replace—the independent clinical judgment of healthcare professionals, who are expected to review each answer before making diagnoses or treatment decisions. This Privacy Policy describes how we collect, use, disclose, and process personal information when you use the OpenEvidence platform (including, as applicable, the OpenEvidence website, web application, member platform, mobile app, and electronic communications and social media pages), as well as our marketing and other activities described herein (collectively, the “Service”). This Privacy Policy applies to use of the OpenEvidence platform by doctors and other professionals, in their professional capacities for healthcare entities or other businesses (collectively “Medical Professionals”). The OpenEvidence platform is designed for our healthcare partners and their representatives (e.g., Medical Professionals). Accordingly, we treat all personal information we collect about Medical Professionals as pertaining to individuals in their professional capacities and not in their individual capacities. Medical Professionals are permitted to upload patient health information to the OpenEvidence platform solely in their professional capacities. While this Privacy Policy applies to information that we process about Medical Professionals, our use of information that we process on behalf of our healthcare partners, such as protected health information for health care systems and hospitals, is governed by our agreements with such partners, who have their own privacy policies and privacy notices that apply to such information. This Privacy Policy does not apply to our employees, independent contractors or job candidates. This Privacy Policy also describes your privacy rights. See U.S. State Privacy Rights Notice at Collection for additional information if you are a U.S. resident. Personal information we collect Information you provide to us. Personal information you may provide to us to the extent it constitutes personal information under applicable law, includes: Contact data, such as your first and last name, alias, salutation, email address, mailing address and phone number. Demographic data, such as your city, state, country of residence and postal code. Profile data, such as account name, biographical details, preferences, and any other information that you add to your account profile. Communications data based on our exchanges with you, including when you contact us through the Service. Marketing data, such as your preferences for receiving our marketing communications and details about your engagement with them. User-generated content data, such as communications you send to other users through the Service, your comments, inputs, file uploads, survey responses, feedback and other content or information that you make available on the Service. Audio recordings, such as recordings healthcare providers generate during patient visits to produce transcriptions via the OpenEvidence platform. Photos, if you grant permission for OpenEvidence to access your photos or camera on your device. Sensitive Personal Information, such as account username and password, which are considered Sensitive Personal Information under certain privacy laws. Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection. Data about others. We may offer features that help users invite their contacts to use the Service, and we may collect contact details about these invitees so we can deliver their invitations. Please do not refer someone to us or share their contact details with us unless you have their permission to do so. Third-party sources. We may combine personal information we receive from you with personal information of the kinds identified above that we obtain from other sources, including our data providers and data analytics providers; partners, such as healthcare and other partners; ad networks and social media platforms; and other partners that help us provide the Service. Automatic Data Collection. Consistent with your device or browser permissions, which you can adjust, we, our service providers and partners may automatically receive information about you, your device, your interaction with the Service, our communications and other online services, such as IP address, web browser characteristics, general location data (e.g., city and state), language preferences, usage statistics, and dates and times of usage of our Service. Cookies and similar technologies. Some of the automatic collection described above is facilitated by cookies and other technologies. For more information, see our Cookie Notice. How we use your personal information We may use your personal information for the following purposes or as otherwise described at the time of collection: Service delivery and operations. We may use your personal information to: provide and operate the Service; enable security features of the Service; personalize the Service, including remembering the devices from which you have previously logged in and your preferences as you navigate the Service; and fraud prevention and security. Continuing Medical Education. We may process and share your personal information with medical boards to provide you with continuing medical education (CME) credits. Research and development. We may create aggregated, de-identified or other anonymous data from personal information for research and development purposes, including to support emergency response efforts during national healthcare crises; to help our medical society partners provide the content most valuable to Medical Professionals; and to improve our products and services. Personal health information shall never be used for such purposes. Compliance and protection. We may use your personal information to: protect our, your or others’ rights, privacy, or safety; audit our internal processes for compliance with legal and contractual requirements; prevent, identify, investigate or deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft; comply with applicable laws, lawful requests, and legal process; and enforce the terms and conditions that govern the Service. Marketing and advertising. We and our third-party advertising partners may collect and use your personal information for marketing and advertising purposes: Direct marketing. We may send you direct marketing communications and may personalize these messages. You may opt-out of our marketing communications as described in the Opt-out of communications section. Where required by law, we will obtain your opt-in consent prior to sending you marketing communications. Interest-based advertising. We and our third-party advertising partners may use cookies, pixels, or other technologies to collect information about your interaction with the Service, our communications and other third party online services over time, and use that information to serve online ads. We may share user information with advertising partners to facilitate interest-based advertising to those or similar users. We don’t engage in cross-context behavioral advertising, as defined under the CCPA, based on user queries, uploads or chats, or PHI. With your consent. In some cases, we may specifically ask for your consent to collect, use, or share your personal information for further purposes. Cookies and similar technologies. In addition to the other uses included in this section, we may use the cookies and similar technologies described above for the purposes set out in our Cookie Notice. How we share your personal information We may share your personal information with the following parties and as otherwise described in this Privacy Policy, in other applicable notices, or at the time of collection. Medical boards. In connection with the awarding of CME credits. Third parties designated by you. We may share your personal information with third parties where you have instructed us or provided your consent to do so. Service providers. Third parties that provide services on our behalf or help us operate the Service or our business (such as hosting, internet service providers, information technology, foundation AI models, email delivery, marketing, consumer research and website/data analytics). Advertisers, ad agencies, ad networks. Third-party advertising companies for contextual and interest-based advertising purposes. Linked third-party services. If you log into the Service with, or otherwise link your Service account to, a social media or other third-party service, we may share your personal information with that third-party service. The third party’s use of the information will be governed by its privacy policy and the settings associated with your account on its service. Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us. Legal or business authorities. We may be obligated to disclose personal information to law enforcement, government authorities, and private parties in litigation, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above, and we may disclose personal information to entities such as advisors, acquirers, successors, financers or assignees as part of a merger, acquisition, sale, investment or similar transaction, and/or in the event of an insolvency, bankruptcy, or receivership in which personal information is transferred to one or more third parties. Other users and the public. If you choose to post content on message boards or other channels available on OpenEvidence, your profile data and posted content may be visible to, seen or collected by other users of the Service. We make commercially reasonable efforts to verify that the parties with whom our mobile application shares personal information provide a level of protection of personal information consistent with the practices described in this Privacy Policy, except that all such parties described above, other than service providers may, to the extent permitted by law, use personal information as described in their own privacy policies. Your privacy choices In this section, we describe the choices available to you. We will honor any additional rights conferred on you by applicable privacy law. Access or update your information. If you have registered for an account with us through the Service, you may review and update certain account information by logging into your account. Opt-out of communications. If you receive marketing-related emails, you may opt-out by following the unsubscribe instructions in such communications, or by contacting us. Please note that if you choose to opt-out of marketing-related emails, you may continue to receive service-related and other non-marketing emails. You may opt-out of text messages by texting “STOP” in response to a text that you receive or by other reasonable means. Cookies. For more information regarding the use of cookies and similar technologies and your respective options, please see our Cookie Notice. Withdrawal of consent. To deliver certain products and services, we need to collect personal information. If you do not provide the required information, or withdraw your consent to our continued use or disclosure of such personal information, we may not be able to provide those services. Retention Period for Personal Information. We retain personal information to fulfill the purposes for which it was collected, including to deliver the Service, satisfy legal, accounting, or reporting requirements, or prevent fraud. To determine the appropriate retention period for personal information, we may consider factors such as the length of time we provide services to you; the amount, nature, and sensitivity of the personal information; or whether there is a legal obligation to which we are subject. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. Security We employ technical, organizational and physical safeguards that are designed to protect personal information from destruction, alteration, unauthorized access or use, and exposure. However, no Internet or information technologies are fully secure or error free and you should take care in deciding what information you provide. International data transfer We are headquartered in the United States and may use service providers that operate in other countries. Your personal information may be transferred to the United States or other jurisdictions where privacy laws may not be as protective as those in your jurisdiction and may be accessed by courts, law enforcement, and national security authorities in those jurisdictions. Children and Teens The Service is not intended for use by anyone under 18 years of age. If you are a parent or guardian of a minor from whom you believe we have collected personal information, or if information was provided on your behalf when you were under 18, please contact us. If we learn that we have collected personal information through the Service from a minor without the consent of the minor’s parent or guardian as required by law, we will comply with applicable legal requirements to delete the information. Changes to this Privacy Policy The “LAST UPDATED” legend at the top of this Privacy Policy indicates when this Privacy Policy was last revised. We reserve the right to modify this Privacy Policy at any time. We will notify you by updating the “Last Updated” date. This State Privacy Rights Notice At Collection is part of our full Privacy Policy. This section describes how we collect, retain, use, disclose, and share personal information of California residents for the purpose of targeted advertising and the rights these users may have with respect to their personal information. Please note that not all rights listed below may be afforded to all individuals. In addition, we may not be able to process your access, correction or deletion request if you do not provide us with sufficient detail to allow us to confirm your identity and understand and respond to your request. We process personal information for targeted advertising purposes, and you can opt out of this use. We do not otherwise sell your personal information in exchange for something of value. The term “sell” has the legal meaning ascribed to it under California Civil Code subsection 1798.140, rather than its ordinary or everyday meaning. Automated decision making. We do not use your personal information to engage in automated decision-making. Sensitive Personal Information California Residents: We may collect certain categories of Sensitive Personal Information as described in this Privacy Policy. We use Sensitive Personal Information as necessary for certain business purposes, including providing goods or services as requested; ensuring safety, security, and integrity; countering wrongful or unlawful actions; performing services for our business, including maintaining and servicing accounts, providing customer service, verifying customer information, providing analytic services, providing storage, or providing similar services on behalf of our business; activities relating to quality and safety control or product improvement; and other collection and processing that is not for the purpose of inferring characteristics about an individual. We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it. Exercising your right to opt-out of/revoke your consent to the “sale” of your personal information or “sharing” of your personal information for targeted advertising purposes. The terms “sale” and “sharing” have the legal meaning ascribed to them under California Civil Code subsection 1798.140, rather than their ordinary or everyday meaning. You can submit requests to opt-out of targeted advertising and other sales of personal information by clicking the “Your Privacy Choices” link in the footer of openevidence.com, via email to privacyinfo@openevidence.com or by broadcasting the Global Privacy Control signal. These signals set your opt-out preferences only for the particular browser or device you are using and any profile that we associate with that browser or device unless you are logged into your account, in which case we will honor the signal with respect to that browser or device and your account. Verification of Identity; Authorized agents. We may need to verify your identity to process your access, correction, deletion, or appeal requests and reserve the right to confirm your residency. We may need to request your non-public information based on our previous interaction with you, in order to verify your identity and protect against fraudulent requests. If you maintain a password-protected account with us, we may verify your identity through our existing authentication practices for your account and require you to reauthenticate yourself before disclosing or deleting your personal information. If you make a request to delete, we may ask you to confirm your request before we delete your personal information. You may enable an authorized agent to make a request on your behalf. However, we may need to verify your authorized agent’s identity and authority to act on your behalf. Depending on the kind of request you have made, we may require a copy of a valid power of attorney given to your authorized agent pursuant to applicable law. If you have not provided your agent with such a power of attorney, we may ask you to take additional steps permitted by law to verify that your request is authorized, such as by providing your agent with written and signed permission to exercise your State Privacy Law rights on your behalf, the information we request to verify your identity, or confirmation that you have given the authorized agent permission to submit the request. Consumers under 18. We do not have actual knowledge that we have collected, sold, or shared the personal information of residents who are under 18 years of age.
