Terms of Service Effective March 2026 Introduction This Terms of Service (the “Terms”) is a binding agreement between you (“End User” or “you”) and ContraForce Group, Inc. (“ContraForce”). The agreement governs use of ContraForce’s website and services. By accepting, using the site, or accessing services, users acknowledge they’ve read the terms, agree to be bound, and confirm they’re 18 years or older. 1. License Grant ContraForce grants a limited, non-exclusive, nontransferable license for personal, non-commercial use on user-controlled devices, strictly per the stated terms. 2. Modifications to Terms and Services ContraForce reserves discretion to modify terms, privacy policies, and services. Changes are communicated via email with effective dates; retroactive application doesn’t occur. Your continued use of the Services following the posting of any changes to the Terms means you accept those new terms. The company may modify, suspend, or discontinue services without liability. Some changes may require updates to continue access. 3. Communications Users consent to receive communications including emails. Opt-out is available for marketing messages, though transactional communications remain required. 4. ContraForce Account Account creation is required for certain service features. Users are solely responsible for maintaining account confidentiality and password security. You agree that you are responsible for anything that happens through your account until you close your account. Unauthorized access must be reported immediately to ContraForce. 5. Payment Certain service features require payment per the Order Form. When paid by you, these payments are final and non-refundable. ContraForce may offer credits or refunds case-by-case. The company authorizes charging specified payment methods and reserves rights to establish or revise pricing at any time. 6. License Restrictions ContraForce prohibits using services for illegal purposes or violating any laws. Users cannot: (a)Use services illegally or unlawfully (b)Use services unprofessionally at ContraForce’s discretion (c)Copy service portions except as expressly permitted (d)Create derivative works or modifications (e)Reverse engineer, disassemble, or decompile services (f)Remove copyright, trademark, or intellectual property notices (g)Rent, lease, or sublicense services to third parties (h)Circumvent copy protection or security features (i)Create unreasonable infrastructure loads; interfere with services; use scraping tools (j)Create false identities or impersonate others 7. Reservation of Rights Services are licensed, not sold. Users acquire no ownership interest. ContraForce, and its licensors and service providers, reserve and shall retain their entire right, title, and interest in and to the Services. 8. Content and User Content Users retain rights to submitted content. ContraForce requires permission to host, back up, and share user content with affiliates and trusted third parties. 9. Collection and Use of Information; Telemetry and Analytics ContraForce uses automated data collection technologies to operate and improve the Services. This includes Microsoft Azure Application Insights, which collects telemetry data such as page views, user interactions, session identifiers, performance metrics, and error diagnostics. This data is used solely for platform reliability, security monitoring, and product improvement and is not sold or shared with third parties except as described in our Privacy Policy. Azure Application Insights is configured to use session storage rather than persistent tracking cookies. Telemetry session data expires when the browser session ends. By creating an account and using the Services, you acknowledge and consent to this telemetry collection as described herein and in the Privacy Policy. For users located in the European Economic Area (EEA) or United Kingdom, ContraForce processes telemetry data on the basis of its legitimate interests in maintaining platform security, reliability, and service quality (GDPR Article 6(1)(f)). ContraForce has assessed that these legitimate interests are not overridden by your rights and interests, given the limited nature and operational purpose of the data collected. You have the right to object to processing based on legitimate interests at any time by contacting [email protected]. Requests will be assessed in accordance with applicable data protection law. All data collection is subject to the Privacy Policy. Usage of the Services implies acceptance of the data practices described therein. 10. Geographic Availability The Services are operated and hosted by ContraForce in the United States. Users located outside the United States, including in the European Economic Area, are responsible for ensuring their use of the Services complies with applicable local laws. ContraForce processes personal data of EEA and UK users in accordance with applicable data protection law, including the General Data Protection Regulation (GDPR) where applicable, as further described in our Privacy Policy. ContraForce participates in the EU-U.S. Data Privacy Framework as administered by the U.S. Department of Commerce, providing a lawful mechanism for transatlantic data transfers. 11. Updates ContraForce may provide updates including upgrades, bug fixes, and patches at its discretion. Updates may modify or delete features. You agree that ContraForce has no obligation to provide any Updates. 12. Third-Party Materials Services may include third-party content and links. ContraForce is not responsible for Third-Party Materials, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, or quality. Users access third-party materials at their own risk. 13. Term and Termination Agreements commence upon acceptance and continue until terminated. We may suspend or cancel your account without notice to you for any reason or no reason at all. Termination ends the license to use services. 14. Transfer Account on Death Users must designate a beneficiary for account transfer upon death. Without designation, the account transfers to the user’s estate. 15. Disclaimer of Warranties THE SERVICES ARE PROVIDED TO YOU “AS IS” AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. ContraForce disclaims all warranties, express or implied, including merchantability and fitness for purpose. No guarantees regarding compatibility, performance standards, or error correction are provided. 16. Limitation of Liability IN NO EVENT SHALL CONTRAFORCE BE LIABLE FOR ANY LOST PROFITS, DATA LOSS, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES. Liability caps at the lesser of twelve months’ prior payments or $100 USD. 17. Indemnification Users agree to indemnify and defend ContraForce, its officers, directors, employees, and agents from losses arising from service misuse or term breaches. 18. Severability If any provision is illegal or unenforceable, remaining provisions continue in effect with amendments to achieve the original intent. 19. Governing Law Terms are governed by Texas law. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the federal courts of the United States or the courts of the State of Texas, in each case located in Dallas County, Texas. 20. Entire Agreement These Terms, our Privacy Policy, and any statements, rules, or agreements executed on the Services constitute the entire agreement between you and ContraForce. 21. Waiver No failure or delay in exercising rights constitutes waiver. Partial exercise doesn’t preclude further exercise. These Terms govern in conflicts with other agreements. 22.
