You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the service, violate any laws in your jurisdiction (including but not limited to copyright laws). A breach or violation of any of the terms will result in immediate termination of your services. 03 Enterprise console Availability of the service The service, or any feature or part of it, may not be available in all languages or all countries, and BlackFog makes no representation that it is appropriate or available for use in any particular location. To the extent you choose to access and use the service, you do so at your own initiative and are responsible for compliance with any applicable laws. Devices and accounts Use of the service may require compatible devices, internet access and certain software (fees may apply), may require periodic updates, and may be affected by the performance of these factors. BlackFog reserves the right to limit the number of accounts that may be created from a device and the number of devices associated with an account. The latest version of required software may be needed for certain transactions or features. Meeting these requirements is your responsibility. Changing the service BlackFog reserves the right at any time to modify this agreement and to impose new or additional terms or conditions on your use of the service. If BlackFog makes material adverse changes to the service or terms of use, you have the right to terminate this agreement and your account. Limitations on use You agree to use the service only for purposes permitted by this agreement, and only to the extent permitted by applicable law, regulation or generally accepted practice in the applicable jurisdiction. If your use of the service or other behavior intentionally or unintentionally threatens BlackFog’s ability to provide the service or other systems, BlackFog is entitled to take all reasonable steps to protect the service and its systems, which may include suspending your access. Repeated violations may result in termination of your account. 04 App stores and in-app purchases If you accessed or downloaded the app from the Apple Store, you agree to use it only (i) on an Apple-branded product or device running iOS, and (ii) as permitted by the usage rules in the Apple Store Terms of Service. If you accessed or downloaded the app from an app provider, you acknowledge and agree that: •These terms are concluded between you and BlackFog, not the app provider, and as between the two, BlackFog is solely responsible for the app. •The app provider has no obligation to furnish maintenance or support services for the app. •If the app fails to conform to any applicable warranty, you may notify the app provider, which will refund the purchase price (if applicable) and, to the maximum extent permitted by law, will have no other warranty obligation. Any other claims, losses, liabilities, damages, costs or expenses attributable to such a failure are the sole responsibility of BlackFog. •The app provider is not responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation. •If a third party claims that the app or your use of it infringes their intellectual property rights, BlackFog is solely responsible for the investigation, defense, settlement and discharge of that claim to the extent required by these terms. •The app provider and its subsidiaries are third-party beneficiaries of these terms as related to your license of the app, and on your acceptance will have the right to enforce these terms against you as a third-party beneficiary. •You must also comply with all applicable third-party terms of service when using the app. •You agree to comply with all U.S. and foreign export laws and regulations, so that neither the app nor any technical data or direct product of it is exported or re-exported in violation of, or used for purposes prohibited by, those laws. By using the app you represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. 05 Subscriptions renew until you cancel All amounts are payable and charged: (i) for a one-off purchase, such as a lifetime subscription, at the time you place your order; and (ii) for monthly or yearly subscriptions, at the beginning of the subscription and at the time of each renewal, using the payment information you have provided. Each subscription renews automatically for a further period equal in length to the expiring term until you cancel it. You must cancel a monthly or yearly subscription before it renews to avoid being billed for the next period. If you purchased through our site, you can cancel renewal at any time by emailing our support team. If you purchased through an app provider, cancel renewal with that provider. You will not receive a refund for fees already paid for the current subscription period, and you will continue to receive the services ordered until the end of that period. 06 Changes to pricing BlackFog reserves the right to change its pricing terms for subscriptions at any time, and will notify you in advance of such changes becoming effective. Changes do not apply retroactively and apply only to renewals after the changed pricing has been communicated to you. If you do not agree with the change, you may choose not to renew your subscription. 07 Future functionality You agree that your purchases are not contingent on the delivery of any future functionality or features, or dependent on any oral or written public comments made by BlackFog regarding future functionality or features. 08 Personal information Your submission of personal information through our online store is governed by our Privacy Statement. What the product itself collects, and for how long, is set out in our GDPR Statement. 09 Governing law These terms and conditions, and any separate agreements whereby we provide you services, are governed by and construed in accordance with the laws of the State of Wyoming, United States of America.
