4. When and with whom do we share your personal information?

Vendors, consultants, and other third-party service providers. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct.

International Data Transfers. We are based in the United States, and your personal information will be transferred to and processed in the United States, which may not provide the same level of data protection as your home jurisdiction.

We are not certified under the EU-US Data Privacy Framework. We conduct Transfer Impact Assessments where required to evaluate the level of data protection in the receiving country.

We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our website. Some online tracking technologies help us maintain the security of our website, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.
We also permit third parties and service providers to use online tracking technologies on our website for analytics and advertising, including to help us understand how visitors interact with the website and to improve user experience. We use advertising cookies and measurement tags to measure the results of campaigns we run on third-party platforms, including which visits and enquiries follow from an advertisement. 6. How long do we keep your information?
In short: We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, as described in this Privacy notice, or as required or permitted by applicable law. Specific retention periods vary by data category and are summarized below.
6.1. Retention periods
We retain different categories of personal information for different periods based on the nature of the data, the purposes of processing, and applicable legal obligations. 6.2 Criteria for determining retention periods
Where a specific retention period is not prescribed by law, we determine the appropriate period by considering the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure, whether the processing purpose can be achieved through alternative means, and the applicable legal, regulatory, and contractual requirements in the relevant jurisdiction(s).
6.3 Actions upon expiration of the retention period
Upon expiration of the applicable retention period, we shall take one of the following actions:
(a) Deletion. We will permanently and irreversibly delete the personal information from our active systems.
(b) Anonymization. Where deletion is not feasible or where anonymized data retains analytical value, we will irreversibly anonymize the information such that it can no longer be attributed to an identified or identifiable natural person, in accordance with applicable regulatory guidance on anonymization standards.
(c) Secure isolation. Where immediate deletion or anonymization is not technically practicable (for example, where personal information resides in backup archives or disaster recovery systems), we will securely isolate the information from all further processing and implement appropriate technical and organizational safeguards until deletion or anonymization becomes feasible.
6.4 Your rights regarding retention
You may request the erasure of your personal information at any time, subject to applicable legal exceptions. Where we are required to retain certain information to comply with a legal obligation, to establish, exercise, or defend legal claims, or for other purposes permitted under applicable law, we will inform you of the specific basis for our continued retention. 6.5 Jurisdictional considerations
As we serve users globally, retention periods and practices may vary depending on the jurisdiction in which you reside. Where the laws of your jurisdiction impose stricter retention limitations or additional rights, we will comply with those requirements. This includes, without limitation, obligations arising under the EU General Data Protection Regulation (GDPR), the UK General Data Protection Regulation (UK GDPR), Brazil's Lei Geral de Proteção de Dados (LGPD), Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), and the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA).
6.6 Periodic review
We conduct periodic reviews of our data retention practices to ensure that personal information is not retained longer than necessary and that our retention schedule remains aligned with evolving legal requirements and business purposes.
7. How do we keep your information safe?
In short: We aim to protect your personal information through a system of organizational and technical security measures.
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our website is at your own risk. You should only access the website within a secure environment.
8. Do we collect information from minors?
In short: We do not knowingly collect data from or market to children under 18 years of age.
We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the website, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the website. If we learn that personal information from users less than 18 years of age has been collected, we will take reasonable measures to promptly delete such data from our records. This section applies to information collected through the OctoProctor website (octoproctor.com). The OctoProctor proctoring platform is a separate service provided to Testing Institutions, which may be used by individuals under 18 under the direction of a Testing Institution with appropriate consents. 9. What are your privacy rights?
In short: Depending on your state of residence in the US or in some regions, such as the European Economic Area (EEA), United Kingdom (UK), Switzerland, and Canada, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.
In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) not to be subject to automated decision-making. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us by using the contact details provided in the section "How you can contact us about this notice?" below. We will consider and act upon any request in accordance with applicable data protection laws.
If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or UK data protection authority.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. 10. Controls for do-not-track features and global privacy control
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. Because no uniform technology standard for recognizing and implementing DNT signals has been finalized, we do not currently respond to DNT browser signals.
Some browsers and browser extensions support the Global Privacy Control ("GPC") signal, which communicates your opt-out preferences automatically. We recognize and honor GPC signals as a valid opt-out request where required by applicable law. Because we do not sell or share your personal information as those terms are defined under applicable US state privacy laws, GPC signals do not result in changes to the data we process, but we treat such signals as a valid exercise of your right to opt out of sale or sharing.
11. Do United States residents have specific privacy rights?
If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. Request verification

Appeals

California "Shine The Light" Law
California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
