Terms of Service

1. Introduction
Welcome to AlertBrew! These Terms of Service ("Terms") govern your use of our website, applications, and services (collectively, the "Services"). The Services are owned and operated by Mykhailo Rokosh, a sole proprietor doing business as AlertBrew ("AlertBrew", "we", "us", or "our"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.
2. License to Use
Unless otherwise stated, AlertBrew and/or its licensors own the intellectual property rights for all material on AlertBrew. All intellectual property rights are reserved. You may access this from AlertBrew for your own personal and business use, subject to the restrictions set in these terms and conditions.
You must not:
Republish material from the Services.
Sell, rent, or sub-license material from the Services.
Reproduce, duplicate, or copy material from the Services.
Redistribute content from AlertBrew, other than content specifically made for redistribution.
3. User Accounts
To access most features of the Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.
4. Credit System
a. How Credits Work
Credits are a virtual product that can be purchased and used solely to access certain AI features within our platform. Credits are a limited, non-redeemable, non-transferable license that allows you to access digital services. Credits do not represent a deposit or stored monetary value. We are not a bank or money services business.
b. No Monetary Value or Transferability
Credits are not legal tender, have no monetary value and cannot be exchanged for cash, or any other currency. Credits may not be transferred, sold, or assigned to any other person or account.
c. No Cash-Out or Marketplace
Credits may only be used within our platform and may not be exchanged for goods or services outside the platform, nor transferred between accounts. We do not permit any cash-out, withdrawal, or redemption of credits for any form of currency.
d. Refunds
Credit purchases include a 14-day cancellation and refund period, as required by consumer protection law. You may request a refund within 14 days of purchase if no credits have been used. Credits are pooled across purchases and consumed on a first-use basis. By using credits during the 14-day period, you expressly consent to the immediate delivery of digital services and waive your right to cancel or request a refund for that purchase. Once credits are used — in whole or in part — or once the 14-day period has expired, all purchases are considered final and non-refundable, except where required by law.
e. Refund Processing Through Paddle
All credit purchases and refund requests are handled through Paddle, our payment processor. Paddle manages payment collection, taxes, currency conversion, invoicing, and refund execution on our behalf.
To request a refund for an eligible purchase:
Visit paddle.com.
Submit a refund request using the email associated with your AlertBrew account.
Locate your Paddle receipt or transaction ID (included in the email you received after purchase).
Provide the transaction details and a brief explanation of your request.
Important: Refunds are processed by Paddle, not directly by AlertBrew.
The final refunded amount may differ from the original payment due to:
Tax adjustments (calculated by Paddle at refund time).
Currency exchange rate fluctuations.
Payment processor limitations or non-refundable fees.
AlertBrew does not control these adjustments.
f. Expiration & Account Closure
Unused credits expire 12 months after the date of purchase unless otherwise stated at the time of purchase. If your account is suspended or terminated for violation of these Terms, you will forfeit any remaining credits without compensation.
5. Content Liability
We shall not be held responsible for any content that you generate or use in connection with our Services. You agree to protect and defend us against all claims arising from your use of the Services. You agree not to use the service to create, send, or display any content that is libelous, obscene, or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third-party rights.
6. Disclaimer
To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to our website and the use of this website. Nothing in this disclaimer will:
limit or exclude our or your liability for death or personal injury;
limit or exclude our or your liability for fraud or fraudulent misrepresentation;
limit any of our or your liabilities in any way that is not permitted under applicable law; or
exclude any of our or your liabilities that may not be excluded under applicable law.
The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort, and for breach of statutory duty.
As long as the website and the core services are provided, we will not be liable for any loss or damage of any nature. Our liability for services and features accessed via paid Credits is limited to the amount you paid for those Credits.
7. Changes to Terms
We reserve the right to amend these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
