This Privacy Policy reflects our commitment to protecting personal data and the choices we offer you regarding how your data is used. We welcome you to read more about how we keep your information safe, as well as how you can exercise your rights. We will review, update, and amend these policies from time to time, consistent with our business needs and technology. We encourage you to check back periodically for new updates or changes. Your continued use of the service makes up for your acceptance of any change to this Privacy Policy. We are the data controller of your information. We handle and process all data on behalf of our customers. You may decide not to give us discretionary Personal Data; however, without it, we may be unable to provide the full scope of our services or the best client experience. This Privacy Policy describes how Kincode AI will gather, use, and maintain your Personal Information on kincode.ai and platform.kincode.app. It also explains your legal rights with respect to that information. By using the website or services, you confirm that you have read and understood this Privacy Policy and our Terms, together referred to as the Agreement. What personal data do we collect? When registering on our site or buying services, you may be asked to enter your name, email, payment information, or other details to assist with your experience. When you create an account and use the Services, including through a third-party platform, we collect data you provide directly. Account Data: To use certain paid or unpaid features, you need to create a user account. When you create or update your account, we collect and store the data you provide, such as your email address, password, and name, and assign you a unique identifying number. Profile photos: When your organization connects a messaging platform or single sign-on (SSO) provider to the Services, your profile photo may be imported from that service and used to display your user profile in Kincode AI. Personal Data: Information that can be used to identify you specifically, including your name, email address, telephone number, mailing address, billing address, gender, date of birth, or demographic information such as your hometown. You provide this information voluntarily. Refusal may prevent you from accessing certain benefits from the platform. Financial Data: Information related to payment methods, such as credit-card or bank-transfer details. We collect financial data to allow you to purchase services. We store limited financial data; most financial data is transferred to our payment processor, whose privacy policy should explain how it uses, discloses, and protects that data. Contact information: An Authorized User is required to provide contact information, such as an email address, when creating an account on the Services. Minors’ data We do not knowingly collect data from or market to children under 13 years of age. By using the Platform, you represent that you are at least 13 or that you are the parent or guardian of such a minor and consent to the minor dependent’s use of the Platform. If we learn that personal information from a user under 13 has been collected, we will take reasonable measures to promptly delete it. Automatically collected information about your use of our Services or tools When you visit, connect with, or use our service, we may gather, record, or create technical data about you, either directly or with the assistance of third-party Service Providers, including through cookies and other tracking technologies. This information may include your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, and information about how and when you use the Platform. It is primarily needed to maintain the security and operation of the Platform and for internal analytics and reporting. Log and Usage Data: Service-related, diagnostic, usage, and performance information that our servers automatically collect when you access or use the Platform. Depending on how you interact with us, this may include your IP address, device information, browser type, settings, timestamps, pages and files viewed, searches, features used, system activity, error reports, and hardware settings. Device Data: Information about the computer, phone, tablet, or other device used to access the Platform. Depending on the device, this may include the IP address or proxy server, device and application identifiers, location, browser type, hardware model, internet service provider or mobile carrier, operating system, and system configuration. How do we use your details? We process personal data to operate, improve, understand, and personalize our services. We will not collect additional categories of Personal Data or use Personal Data for materially different, unrelated, or incompatible purposes without providing notice. If you have provided an email address, we may send promotional offers or messages about your use of the Services and may receive confirmation when you open an email. If you do not want to receive communications, indicate your preference by emailing us. Fulfil or meet the reason you provided the information, including providing Site services. Send catalogues, information, newsletters, promotional materials, and other offerings from Kincode AI or on behalf of partners and affiliates. Communicate with you about the Services, including service announcements, updates, or offers. Correspond with you. Compile anonymous statistical data for our own use or a third party’s use. Assist law enforcement as necessary. Analyse trends to improve our platform and offerings. Personalise and develop our site and services and improve our offerings. Provide features or functionality of the Services. Support marketing and promotions. Create, maintain, customise, and secure your account. Personalise your experience and deliver content, products, and services relevant to your interests. Respond to law-enforcement requests and comply with applicable law, court orders, or government regulations. Prevent illegal activity, fraud, and abuse. Help the site serve you better. How to opt out When you engage us for Services or make an enquiry, you may be asked to consent to promotional communications. You can opt out of future promotional emails by following the instructions in the email or by contacting miguel@kincode.ai. The published policy states that requests are logged in the Delve platform, assigned to the DPO, and tracked through a Consent Withdrawal Form until resolution. Do Not Track Various browsers offer a Do Not Track or DNT option that sends a signal to websites about the user’s preference. Kincode AI does not currently commit to responding to browser DNT signals because industry groups, technology companies, and regulators have not adopted a consistent standard for interpreting user intent. Kincode AI will continue monitoring developments around DNT technology and the implementation of a standard. How we use cookies We use cookies and similar technologies to recognise you when you sign in, provide recommendations and personalised content, remember preferences, detect and prevent fraudulent activity, improve security, conduct research and diagnostics, and measure and analyse the performance of our offerings. Strictly Necessary Cookies: Required for the Platform to function and generally set in response to actions such as setting privacy preferences, logging in, or filling in forms. Functional Cookies: Enable enhanced functionality and personalisation and may be set by us or third-party providers whose services we add to our pages. Performance Cookies: Allow us to count visits and traffic sources, understand which pages are most and least popular, and see how visitors move around the site. Targeting Cookies: May be set through the site and used to build a profile of your interests and show relevant adverts on other sites. We load the OpenAI Ads pixel only after you agree to Marketing cookies. Google Analytics cookies We use Google Analytics to investigate use of our site. Google Analytics gathers information about site use through cookies, which is used to create reports about use of the site. Replay collection is optional, sampled, and configured with conservative masking; form inputs and other sensitive content are masked by default. Amplitude processes this data as our service provider. You can withdraw analytics consent at any time through Cookie Settings, which stops future replay collection. What are your choices regarding cookies? You can change your cookie preferences at any time through Cookie Settings in the website footer. Blocking some types of cookies may affect your experience. You can also manage cookies through your browser settings. If you block or reject cookies, some features and services may not work, and you may need to adjust preferences each time you visit the Platform. GDPR — Customer data processing appendix Customer Data means personal data that Kincode AI processes on a Customer’s behalf through the Services, as described in the Data Processing Agreement. Data Protection Laws means data protection laws and regulations applicable to a party’s processing of Customer Data, including EU Data Protection Law and applicable Non-EU Data Protection Laws. EU Data Protection Law includes Regulation (EU) 2016/679 (GDPR), Directive 2002/58/EC, applicable national implementations, and applicable UK legislation replacing or converting the GDPR into domestic law. Europe means the European Union, European Economic Area and their member states, Switzerland, and the United Kingdom. Non-EU Data Protection Laws means the California Consumer Privacy Act, Canada’s Personal Information Protection and Electronic Documents Act, and Brazil’s General Data Protection Law. SCCs means the standard contractual clauses for processors approved by the European Commission or Swiss Federal Data Protection Authority, as applicable, for transfers of Customer Data from the European Union. Services Data means data relating to the Customer’s use, support, or operation of the Services, including volumes, activity logs, frequencies, bounce rates, and information about communications generated through the Services. Customer data processing responsibilities Parties’ roles: Where EU Data Protection Law or the LGPD applies, the Customer is the controller and Kincode AI is a processor acting on behalf of the Customer. Purpose limitation: Kincode AI will process Customer Data only according to the Customer’s documented lawful instructions, as necessary to comply with applicable law, or as otherwise agreed in writing. Processing outside those instructions requires prior written agreement. Prohibited data: The Customer will not provide Sensitive Data for processing under the Agreement. The published policy states that the DPA does not apply to Sensitive Data. Customer compliance: The Customer represents that it complies with applicable laws, provides required notices, and has obtained the consents and rights needed for Kincode AI to process Customer Data. The Customer is responsible for the accuracy, quality, legality, and acquisition of Customer Data and for laws applicable to communications created, sent, or managed through the Service. Lawfulness of instructions: The Customer must ensure its instructions do not cause Kincode AI to violate applicable law. Kincode AI will notify the Customer if it believes an instruction violates the GDPR or a UK implementation of the GDPR, unless prohibited by law. Your legal rights Under certain circumstances, you may have rights under data protection laws in relation to your data. Request access to your data and receive a copy of personal data we hold about you. Request correction of incomplete or inaccurate personal data. Request deletion of personal data where there is no good reason for continued processing, subject to applicable legal exceptions. Object to processing based on legitimate interests and object to processing for direct marketing. Request restriction of processing while accuracy, lawfulness, legal claims, or an objection are assessed. Request transfer of data you provided to you or a third party in a structured, commonly used, machine-readable format where the right to portability applies. Withdraw consent at any time where processing relies on consent, without affecting processing carried out before withdrawal. How do we protect your details? We have implemented industry-accepted administrative, physical, and technology-based security measures designed to protect personal information against loss, misuse, unauthorised access, and alteration. People and vendors with access to personal information are subject to legal and professional safeguarding obligations. The published policy states that Kincode AI does not use vulnerability scanning and/or scanning to PCI specifications. The published policy states that Kincode AI uses regular malware scanning. We implement security measures when a user enters, submits, or accesses information. No method of internet transmission or electronic storage is completely secure, and we cannot guarantee absolute security. Kincode AI prohibits unauthorised access to personal information stored on its servers and states that it will investigate illegal access. CAN-SPAM Act The published policy states that Kincode AI collects email addresses to send information and respond to questions and intends to comply with the CAN-SPAM Act. Do not use false or misleading subjects or email addresses. Identify advertising communications appropriately. Include the physical address of the business. Monitor third-party email-marketing services for compliance where used. Honour opt-out and unsubscribe requests promptly. Allow users to unsubscribe through the link at the bottom of each email. Limitation of liability Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some limitations may not apply to you. The published policy states that Kincode AI makes no legal representation that the Platform or products are appropriate or available outside Spain and that users accessing the Platform from outside Spain are responsible for compliance with applicable foreign laws. Governing law and jurisdiction The Platform originates from Spain. The published policy states that the laws of Spain govern and that disputes arising out of or in connection with these terms are subject to the exclusive jurisdiction of Spain. Changes to this privacy notice We may change this Privacy Policy as our Services evolve. We may notify you by placing a notice on the Kincode AI Platform, sending an email, or using another appropriate means. Legal notices still govern use of the Services if you have opted out of legal-notice emails or have not provided an email address. The use of information we collect is subject to the Privacy Policy in effect when the information is collected.
