Limitation of liability In no event shall PMA, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose. If you are subscribed to Power My Analytics Services with an auto-renewable subscription, Power My Analytics may increase the fees regularly. Upon purchasing any Paid Services, you give Power My Analytics or its designated third-party payment processors the right to charge the payment method you’ve provided. You confirm and guarantee that you have the legal authority to use this payment method. This charge includes all fees associated with your purchase, along with any applicable taxes, and you agree to our payment provider storing your payment method information. If payment is not received from your payment method provider, you commit to settling all due amounts on demand. In such cases, Power My Analytics has the right to suspend your access to the Services until the full payment is received or terminate the Terms of Service. If you find our “Paid Services” unsatisfactory, you may request a complete refund: Within 14 days of your initial monthly payment if you are on a monthly payment plan Within 30 days of your initial annual payment if you are on a yearly payment plan Once these periods have passed, Power My Analytics is under no obligation to provide any refunds, unless there is a considerable issue with the delivery of your “Paid Services”. Such cases will be reviewed individually. Disclaimer Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Changes We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
