These Terms of Service ("Terms") govern your use of the PostalAgent website and service located at PostalAgent.com ("Service", "Company", "we", "us", or "our").
By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Description of Service
PostalAgent is a software-as-a-service platform that allows users to upload contact information and send physical postcards through the mail. We facilitate the printing and mailing of postcards on your behalf through third-party printing and postal services.
2. Account Registration
To use PostalAgent, you must create an account. You agree to:
Provide accurate, current, and complete information during registration
Maintain the security of your password and account
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Acceptable Use
You agree to use PostalAgent only for lawful purposes. You must NOT use the Service to:
Send postcards to individuals who have not consented to receive mail from you
Upload contact information that you do not have permission to use
Send content that is defamatory, obscene, threatening, harassing, or hateful
Send spam, unsolicited advertising, or bulk mailings without proper consent
Impersonate any person or entity
Violate any applicable laws, including privacy laws, anti-spam laws, or postal regulations
Send content that infringes on any third party's intellectual property rights
You are solely responsible for ensuring you have the legal right to contact each recipient and that your postcard content complies with all applicable laws.
4. User Data and Contact Information
You retain ownership of any contact data you upload to PostalAgent. By uploading contact information, you represent and warrant that:
You have obtained all necessary consents to use and share this information
The data was collected in compliance with applicable privacy laws
You have the legal right to send physical mail to each contact
We process your uploaded data solely to fulfill your postcard orders. Please refer to our Privacy Policy for details on how we handle data.
5. Payment Terms
PostalAgent operates on a pay-per-use basis. By using our paid services, you agree that:
All fees are charged in USD and are non-refundable unless otherwise stated
You authorize us to charge your provided payment method for all fees incurred
Prices are subject to change with reasonable notice
You are responsible for any applicable taxes
Failure to pay may result in suspension or termination of your account.
6. Service Limitations
While we strive to provide reliable service, you acknowledge that:
Delivery times depend on third-party postal services and are not guaranteed
We are not responsible for mail that is lost, delayed, or undelivered by postal carriers
We are not liable for postcards sent to incorrect addresses provided by you
The Service may experience downtime for maintenance or unforeseen issues
We do not guarantee that postcards will be delivered or that recipients will receive them by any specific date.
7. Intellectual Property
The PostalAgent platform, including its design, code, features, and branding, is owned by PostalAgent and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of our Service.
You retain ownership of any content (text, images) you create for your postcards, and you grant us a limited license to use that content solely to fulfill your orders.
8. Termination
You may cancel your account at any time through your account settings or by contacting us.
We may suspend or terminate your account immediately, without notice, if you:
Violate these Terms
Use the Service for illegal purposes
Fail to pay applicable fees
Engage in conduct that harms other users or the Service
Upon termination, your right to use the Service ceases immediately. We may delete your account data after termination.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by law, PostalAgent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
This limitation applies regardless of the legal theory and even if we have been advised of the possibility of such damages.
11. Indemnification
You agree to indemnify and hold harmless PostalAgent, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Content you send through the Service
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
