AI-Specific Use Restrictions Our AI applications are designed to assist human agents, not replace them. By using our AI applications, you acknowledge and agree that: AI-generated outputs are probabilistic and may be inaccurate or incomplete AI responses are not guaranteed to be correct, up to date, or contextually appropriate Final decisions and actions must be taken by a human You remain fully responsible for customer communications and outcomes You must not: Allow the AI to operate without reasonable monitoring Use the AI in safety-critical or regulated decision-making contexts Use the AI as the sole decision-maker in customer-facing processes 7. Customer Responsibilities You are responsible for: Ensuring you have the legal right to process any data submitted to our services Informing your own end users about your use of AI and automation Configuring Zendesk and related systems securely Reviewing AI outputs before acting on them Maintaining appropriate internal controls and oversight We are not responsible for: How you configure your Zendesk environment How you choose to use or act upon AI outputs Errors caused by incorrect inputs, configurations, or misuse 8. Suspension and Termination for Misuse We reserve the right to: Suspend or restrict access to our services or AI applications Terminate usage where prohibited or abusive behavior is detected Such actions may be taken without prior notice where required to: Protect our systems Comply with legal obligations Prevent harm or misuse 9. Intellectual Property Rights All intellectual property rights related to our website, services, applications, and content are owned by or licensed to Roca.work SL and Kaidominic Devs SRL, unless expressly stated otherwise. License to Use Our Services and AI Applications Subject to these Terms and any applicable commercial agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to: Access and use our website Use our services and AI applications Access provided documentation and materials This license is granted solely for your internal business purposes and only for the duration of your contractual relationship with us. 11. Ownership of AI Outputs As between you and Roca.work: You retain ownership of your original input data submitted to the AI applications You may use AI-generated outputs for your internal business purposes However: AI-generated outputs may be similar or identical to outputs generated for other users We do not guarantee exclusivity or originality of AI-generated outputs Nothing in these Terms transfers ownership of our underlying technology, models, prompts, or systems to you. 13. Feedback If you provide feedback, suggestions, or ideas regarding our services or AI applications, you grant us a royalty-free, perpetual, irrevocable, worldwide license to use that feedback for any purpose, without obligation to you. 14. Disclaimers Our website, services, and AI applications are provided on an “as is” and “as available” basis. To the maximum extent permitted by law: We do not guarantee that AI-generated outputs will meet your specific requirements Roca.work does not warrant that the services or AI applications will be uninterrupted, timely, secure, error-free, or free from viruses or other malicious software, or that they will meet the customer’s business, legal, or regulatory requirements. No information, output, or advice obtained by the customer from Roca.work or through the services shall create any warranty not expressly stated in the applicable agreement. These disclaimers apply to the fullest extent permitted by applicable law. We do not guarantee that results achieved through the use of our services will be accurate, complete, or suitable for any particular purpose If we determine we cannot correct the Services, either party may terminate the affected Services, and we will refund any prepaid fees for those Services covering the remainder of the Subscription Term as of the effective date of termination. This is Customer’s only remedy for breach of this warranty. This warranty does not cover any misuse or unauthorized changes to the Services made by Customer or others acting on its behalf. You acknowledge that: The use of AI involves inherent limitations Outputs depend on the quality and context of the input data Human judgment remains essential when using AI-assisted tools Roca.work maintains certified management systems under ISO 9001 and ISO/IEC 27001:2022, supporting structured processes, risk management, and information security governance. These certifications do not constitute a warranty of uninterrupted, error-free, or risk-free services. 15. No Professional Advice Our services and AI applications do not provide legal, financial, medical, or other regulated professional advice. Any information or AI-generated output provided: Is for general informational and assistance purposes only Should not be relied upon as a substitute for professional judgment You are solely responsible for verifying information before acting upon it. 16. Third-Party Services Our services may integrate with or rely on third-party platforms, including but not limited to: Zendesk Cloud infrastructure providers AI model providers We are not responsible for: Availability or performance of third-party services Errors or disruptions caused by third-party platforms Changes made by third parties that affect integrations Your use of third-party services is governed by their respective terms and policies. 17. Limitation of Liability To the maximum extent permitted by applicable law: Roca.work shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, business interruption, or reputational harm. Roca.work shall not be liable for damages arising from: reliance on AI-generated outputs automated or semi-automated actions configuration choices made by the customer misuse or improper use of the services Our total aggregate liability arising out of or in connection with these Terms or the use of our services shall not exceed the total fees paid by you to Roca.work in the three (3) months preceding the event giving rise to the claim. This limitation applies regardless of the legal theory under which the claim is brought. 18. Indemnification You agree to indemnify, defend, and hold harmless Roca.work, its affiliates, directors, officers, employees, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: Your use of the services or AI applications Your violation of these Terms Your breach of applicable laws or regulations Your failure to properly inform your end users about your use of AI or automation Data or content submitted by you to the services This indemnification obligation survives termination of these Terms. 19. Termination We may suspend or terminate your access to the website, services, or AI applications: If you violate these Terms If your use poses a legal, security, or operational risk If required to comply with applicable law Termination may occur with or without prior notice, depending on the circumstances. Upon termination: Your right to use the services immediately ceases Any provisions that by their nature should survive termination (including liability limitations, indemnification, and intellectual property provisions) shall remain in effect 20.
