Please read these terms carefully
These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with the https://www.genderapi.io website (the "Service") operated by Onur Öztürk, a sole proprietor trading as Ozan Soft ("us", "we", or "our"). Ozan Soft is registered in Türkiye under tax identification number 7140188422.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

Purchases and Payment Methods
GenderAPI offers monthly subscriptions and one-time credit packages. The current prices, included request volumes and available purchase options are displayed on the Pricing page before checkout.
If you purchase a product or service made available through the Service ("Purchase"), you may be asked to supply information relevant to your Purchase, including billing and payment information. GenderAPI currently supports credit-card payments and USDT cryptocurrency payments on the Tron (TRC20) network. The payment methods actually available for a particular order are those shown at checkout.
You represent and warrant that you have the legal right to use the selected payment method and that the information you supply is true, correct and complete. Payment credentials may be processed by the applicable payment provider; GenderAPI receives and retains only the billing and transaction information needed to provide the purchase and meet documented obligations.

Availability, Errors and Inaccuracies
We are constantly updating our offerings of products and services on the Service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other websites.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Contests, Sweepstakes and Promotions
Any contests, sweepstakes or other promotions (collectively, "Promotions") made available through the Service may be governed by rules that are separate from these Terms. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

Monthly Subscriptions
Subscription plans are billed in advance on a monthly recurring basis. The included credit allowance resets at the beginning of each billing cycle, and unused monthly credits do not roll over.
A subscription renews each month using the supported payment method associated with the purchase unless it is cancelled before the next renewal charge or GenderAPI ends the subscription. You may cancel renewal through the actions available for the relevant API key in your signed-in dashboard or by contacting support.
Cancellation prevents future renewal charges but does not itself reverse a charge that has already occurred. For a completed initial or renewal charge, any refund request must be submitted within the three-day window described below.
If a renewal payment cannot be completed, access to the next subscription allowance may be delayed, suspended or require a new purchase. Any recovery options available for that payment will be shown in the signed-in application or communicated by support.

Fee Changes
GenderAPI may change subscription fees or one-time package prices. A one-time package is charged at the price presented and accepted at checkout. A later price change does not alter credits already purchased.
A subscription price change applies no earlier than the next billing cycle after reasonable advance notice, giving you an opportunity to cancel before the changed price is charged. Continuing the subscription after the change takes effect authorizes renewal at the notified price.

Refunds
GenderAPI's published policy provides a refund when a refund request is submitted within three days of purchase. It covers initial purchases and subscription renewals, subject to these Terms and applicable law; it does not limit mandatory consumer rights.
For a subscription renewal, the three-day period begins on the date of the applicable renewal charge. If none of the credits supplied by the relevant purchase have been used, the eligible purchase amount is refunded in full. If some credits have been used, the refund is reduced proportionally by the number of credits used from that purchase, and only the value attributable to the remaining credits is refunded. Submit the request to [email protected] and identify the relevant account or order. See our Delivery & Returns Policy for request instructions. A completed refund ends access to the refunded plan or deactivates the remaining credits supplied by that purchase. Card refunds are returned through the applicable card-payment channel. Cryptocurrency refunds are made in USDT on the Tron (TRC20) network. Approved refunds are completed within 5–10 business days. Purchases made through a marketplace or reseller are also subject to that provider's mandatory refund process and terms.

Accounts
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Query and File Data
Under the published policy, successful GenderAPI query inputs are processed to provide results and are not retained as reusable query records. Separate technical and security logs follow the Privacy Policy retention schedule. Email queries are not retained as reusable query records. Automated inference, including AI-assisted processing where offered, runs on a private GenderAPI-operated AI server; query inputs are not sent to a third-party AI provider, used for model training or retained in AI logs. Contracted network and hosting providers may process data only as necessary to operate the Service. The Privacy Policy permits unresolved non-email queries to be retained for up to 12 months for coverage improvement, followed by deletion or irreversible anonymization; lawful basis, access controls and user rights are described in the Privacy Policy and GDPR privacy information.
The published Privacy Policy schedules Excel and CSV uploads for removal from active systems within five days and offers earlier active-workspace removal after export. Rolling backups may persist for up to 15 additional days. See the Privacy Policy for current details.

genderapi.io has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that genderapi.io shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Limitation of Liability
In no event shall genderapi.io, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
genderapi.io, its subsidiaries, affiliates, and licensors do not warrant that: (a) the Service will function uninterrupted, secure or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating to them or the Service shall be governed by the laws of the State of New York, United States, and applicable United States federal law, without regard to conflict-of-law principles.
Subject to any mandatory consumer-protection rights that apply in your place of residence, the state and federal courts located in New York County, New York shall have exclusive jurisdiction, and you consent to the personal jurisdiction of those courts.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Service.
