Jumpe AI Terms and Conditions of Use Welcome to the Jumpe AI - Analytical Agents platform, owned by PROGRAMIND INTELIGENCIA DIGITAL LTDA., enrolled with Tax ID (CNPJ) 22.894.611/0001-63, located at Avenida Angélica, 2220, Consolação, São Paulo – SP, Brazil, ZIP 01.228-200 (hereinafter the “Licensor”). These terms and conditions of use (the “Terms of Use”) apply to the Jumpe AI platform available at https://jumpe.ai and to all associated websites operated by the Licensor. The Jumpe AI platform is operated by the Licensor to provide access to the analytical agents, products, services and opportunities offered. The use of the Licensor's products and services is governed by these Terms and by specific conditions that may be made available on the platform itself. Important — please read carefully By clicking “I agree”, “Accept” or “Done”, you acknowledge that you are authorized to enter into these Terms of Use and the resulting service agreement (the “Agreement”). If you are accepting on behalf of your employer or another entity (the “Customer”), you represent that you have the legitimacy and powers to represent it and to agree to all terms regarding the use of Jumpe AI products and services by the Customer. If you do not agree with these Terms, the Privacy Policy and other documents, or are not authorized to represent the Customer, do not click “I agree”, “Accept” or “Done”. Click “I do not accept” or close the window to interrupt registration on the Jumpe AI platform. The Licensor reserves the right, at its sole discretion, to change the Jumpe AI platform and these Terms at any time. Each time you use the platform, we recommend reviewing the current version. Continued use after the publication of changes implies agreement with them. If you are dissatisfied with the platform, its content or these Terms, your sole and exclusive option is to stop using it. The Licensor will notify users whenever there are material changes. Content and Intellectual Property All texts, graphics, interfaces, photographs, trademarks, logos, sounds, AI models, prompts, agent flows and code (collectively, the “Content”), including the design, structure, arrangement and organization of the Content on the Jumpe AI platform, are owned by or licensed to the Licensor and are protected by applicable intellectual property and copyright laws. Except as expressly provided in these Terms, no part of the platform and no Content may be copied, reproduced, republished, decoded, translated, transmitted or distributed in any way, including reverse engineering, without the Licensor's prior, express consent. You may use information about Jumpe AI products and services provided that: (1) you do not remove proprietary notices; (2) you use it solely for personal, non-commercial purposes; (3) you do not modify it; and (4) you do not make any additional statements or warranties. Communications Use of the Jumpe AI platform and the sending of emails or messages are electronic communications made by you to the Licensor. You agree to receive electronic communications — by email, in-platform notices, WhatsApp messages and app notifications. Such communications meet any legal requirement of written form and are valid between the parties. Privacy We recommend reading our Privacy Policy. By using Jumpe AI, you acknowledge that internet transmissions are never fully private, secure or error-free, and that messages may be intercepted by third parties, even when encrypted. The Licensor uses its best efforts and available resources to ensure the security of information, but is not responsible for attacks, intrusions or hacking attempts. Platform uses and restrictions You may not use any procedure, automated tool, program, algorithm or methodology (or equivalent manual process) to access, copy or monitor any part of Jumpe AI or the Content, nor reproduce or bypass the navigation structure, nor obtain materials by means not made available by the Licensor. You may not attempt to gain unauthorized access to any part of the platform, connected systems or networks, nor test the vulnerability of Jumpe AI or track other users' information. You agree not to impose excessive load on the infrastructure, not to interfere with the operation of the platform, not to forge headers, not to impersonate third parties and not to use Jumpe AI for illegal or prohibited purposes. You agree not to use the platform for: Any unlawful acts and/or violation of applicable legislation; Uploading or transmitting content that promotes prejudice, hate or illegal activities; Acts contrary to morals and good manners; Threats, coercion, physical or moral constraint against the Licensor or third parties; Violation of third-party rights. Transactions on the platform Any transactions for products or services available through Jumpe AI are subject to these Terms, the Privacy Policy and the conditions applicable at each point of the platform. Transactions may include date, deadline, scope or availability limitations indicated in the specific details. Jumpe AI may offer a free plan and paid plans. The Licensor reserves the right to change the conditions, including pricing, with prior notice, and the user may choose to continue or close the account. You agree that transactions are non-refundable, non-transferable and may be limited by specific details. After purchase, the Licensor may verify payment information and identity and reject or cancel orders in case of discrepancy, payment failure or fraud indication, notifying the user. Account and Password As part of using Jumpe AI, you may receive access credentials when completing registration. You are responsible for keeping the password and account confidential and for all activities carried out using them. You agree to: Immediately notify the Licensor of any unauthorized use of the password or account, or any security breach; End the session at the end of each use and prevent access by unauthorized third parties. Limitation of Liability To the extent permitted by applicable law, the Licensor will be liable only for concrete and directly proven damages. The Licensor, its suppliers or third parties mentioned on the platform will not be liable for indirect damages, lost profits, loss of data or business interruption arising from the use or inability to use Jumpe AI. Information Security Data security. We implement and maintain physical, electronic and managerial procedures to protect against loss, misuse, unauthorized access, alteration or disclosure of subscriber data. Such measures include encryption in transit and at rest, tenant isolation and protected backups. Data transmission. You acknowledge that the use of the services involves transmission of data over the internet and other networks, which may potentially be accessed by unauthorized parties. You are solely responsible for protecting your logins and passwords and must notify us immediately in case of suspected security breach via the email contato@jumpe.ai. Data ownership. Subscriber data is your property. You grant the Licensor a non-exclusive, worldwide, royalty-free license to use, copy, transmit, sublicense, index, store, aggregate and display such data to the extent necessary to provide the contracted services, technical support and account management. Termination The Licensor may, in any circumstance and without prior notice, immediately terminate your account and/or access to the service in the following cases: Violation of these Terms or other incorporated agreements; Requests from government authorities or judicial decisions; Unexpected technical or security issues; Prolonged periods of inactivity; User involvement in fraudulent or illegal activities; Non-payment of fees due in connection with the services. Applicable Law and Jurisdiction All matters related to the access or use of Jumpe AI, these Terms, the Privacy Policy and other conditions will be governed and interpreted by the laws of the Federative Republic of Brazil. The Forum of the Capital District of the State of São Paulo is hereby elected to settle any doubts, questions or disputes arising from this contract.
