If you are using Samskit on behalf of a company, that company is the "Customer" and is responsible for ensuring that its employees use the Service in accordance with applicable laws, including the data protection laws of its jurisdiction.
With respect to personal data contained in recordings, transcripts, messages and CRM data, the Customer is the controller and Samskit acts as processor (operadora), processing such data in accordance with the Customer's instructions. With respect to registration, billing, support, platform usage and website data, Samskit is the controller. If the Customer has a signed contract with Samskit, the contract prevails over this Policy in the event of conflict.

4. Call Recording - Consent and Disclosure
Samskit joins sales calls as a bot participant. The bot's presence is disclosed to all meeting participants through its name visible on the meeting screen. It is the Customer's responsibility to ensure that all participants in a recorded meeting have been notified of and have consented to the recording, in accordance with applicable laws.
Samskit provides the technical capability to record and does not control whether recording is legally permitted on any given call. Customers are solely responsible for complying with applicable recording consent laws.
Depending on the content of the conversations, recordings and messages may contain sensitive personal data. It is the Customer's responsibility to determine the appropriate legal basis and to avoid unnecessary processing of such data.
