Welcome to RentSolo. These Terms & Conditions ("Terms") govern your access to and use of RentSolo's website, mobile applications, and services (collectively, the "Service"). Please read them carefully. By accessing or using the Service you agree to be bound by these Terms.
1. Definitions
In these Terms:
“RentSolo”, “we”, “us” or “our” means RentSolo and its affiliates.
“User”, “you” or “your” means any individual or entity that accesses or uses the Service.
“Owner” means a property owner or manager listing property on the Service.
“Renter” means a user seeking to view, book, rent, or otherwise engage with a listing.
“Listing” means any property listing, description, image, price, or availability posted on the Service.
“Content” means text, images, video, files, messages, listings, reviews, and other materials provided by users or by RentSolo.
2. Acceptance of Terms
By creating an account, accessing, or using the Service you represent that you have the legal capacity to enter into these Terms and agree to be bound by them, including our Privacy Policy. If you do not agree to these Terms, do not use the Service.
3. Eligibility
The Service is intended for users who are at least 18 years old. By using the Service you represent and warrant that you are 18 or older and have the authority to enter into these Terms.
4. Account Registration & Security
To use certain features you must create an account. You agree to:
Provide accurate, current, and complete information during registration and keep that information up-to-date.
Maintain the security of your account credentials and not share your password with others.
Notify us immediately of any unauthorized use of your account or any other security breach.
You are solely responsible for all activity that occurs under your account.
5. Description of Service
RentSolo is an online marketplace that enables Owners to list rental properties and Renters to discover and schedule tours for rentals. RentSolo provides the platform and related tools but does not own, manage, or control the properties listed. All rental agreements are between Owners and Renters unless otherwise specified.
6. User Content & Listings
You retain ownership of content you post, but by posting you grant RentSolo a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, publish, translate, distribute, perform, and display such content in connection with the Service. You represent and warrant that:
You have all rights necessary to post the content and grant the license above.
Content is accurate, not misleading, and does not infringe any third-party rights.
You will not post prohibited content (illegal, defamatory, pornographic, or infringing content).
We may remove or disable access to content that violates these Terms or applicable law.
7. Payments, Fees and Refunds
If you purchase any paid service, listing fee, or other paid feature, you agree to pay the applicable fees and taxes. Payment processing is handled by third-party payment processors and is subject to their terms. Refunds (if any) will be provided according to the refund policy displayed at the time of purchase or as otherwise agreed. We may change fees at any time; fee changes do not apply to transactions already processed.
8. Prohibited Conduct
When using the Service you must not:
Use the Service for illegal purposes or to solicit others to perform illegal acts
Upload viruses, malware, or any code that may harm the Service or its users
Impersonate any person or entity or misrepresent your affiliation with a person or entity
Harvest or collect other users’ information without consent
Circumvent fees or payment systems provided by RentSolo
Use automated means (bots, scripts) to access, monitor, or copy the Service without our prior written permission
9. Third-Party Services and Links
The Service may contain links to third-party websites or services that are not owned or controlled by RentSolo. We are not responsible for the content, privacy policies, or practices of third-party services. Use of third-party services is at your own risk and subject to the third party’s terms.
10. Privacy and Communications
Your use of the Service is subject to our Privacy Policy, which explains how we collect and process personal information. By using the Service you consent to receiving electronic communications from us (including email and SMS) related to your account. For SMS communications we will only send messages where you have consented; you may opt out by replying STOP or contacting us.
11. Intellectual Property Rights
All rights, title, and interest in and to the Service (excluding user content) and all related intellectual property rights are the exclusive property of RentSolo or its licensors. You shall not reproduce, modify, create derivative works, distribute, or publicly display any portion of the Service except as expressly permitted by RentSolo.
12. DMCA & Copyright Policy
If you believe your copyrighted work has been posted in a way that constitutes infringement, please notify our designated agent at chloe@rentsolo.com with sufficient information to investigate. We will respond in accordance with applicable law.
13. Disclaimers; No Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. RentSolo DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RentSolo AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO RentSolo IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
15. Indemnification
You agree to indemnify, defend, and hold harmless RentSolo and its affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your use of the Service, or your infringement of any rights of a third party.
16. Termination and Suspension
We may suspend or terminate your access to the Service at any time for any reason, including for violation of these Terms or applicable law. Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination will survive (for example, Intellectual Property, Limitation of Liability, Indemnity, and Governing Law).
17. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to conflict of law principles. Subject to the arbitration provision below, you and RentSolo submit to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois for any disputes that are not subject to arbitration.
18. Dispute Resolution and Arbitration
Please read this section carefully — it affects your rights.
Informal Resolution: Before initiating a claim, you agree to contact us at chloe@rentsolo.com and attempt to resolve the dispute informally.
Binding Arbitration: Except for certain types of disputes (such as small claims court claims or where prohibited by law), you and RentSolo agree to resolve disputes through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Cook County, Illinois unless you and RentSolo agree otherwise.
Class/Representative Action Waiver: You and RentSolo agree to pursue claims solely on an individual basis. Class arbitrations and class actions are not permitted.
If you do not agree to arbitration, you may opt out by notifying RentSolo in writing within 30 days of first accepting these Terms. To opt out, email: chloe@rentsolo.com.
19. Export Controls, Sanctions & Compliance
You must comply with all applicable export laws and regulations. You represent that you are not located in, under the control of, or a national or resident of any country subject to an applicable trade embargo or sanctions.
20. Changes to These Terms
We may modify these Terms from time to time. Material changes will be posted with an updated "updatedOn" date and, where required by law, we will provide additional notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.
21. Miscellaneous
These Terms constitute the entire agreement between you and RentSolo regarding the Service. If any provision is found invalid or unenforceable, the remaining provisions will remain in effect. Failure to enforce any right does not waive that right.
