Your CPNI includes the types of telecommunications and interconnected VoIP services you currently purchase or subscribe to, how you use those services (for example, your calling records), and billing information related to those services. Your MightyCall telephone number, name and address do not constitute CPNI.
MightyCall does not sell, trade or otherwise share your CPNI with anyone outside of MightyCall or with anyone who is not authorized to represent us to offer our services or to perform functions on our behalf, except as the law may require or you may authorize.
We may use or disclose your CPNI for legal or regulatory reasons such as to respond to a court order, to investigate fraud, to protect our rights or property, to protect against the unlawful use of our services, or to protect other users. You have a right and we have a duty under federal law to protect the confidentiality of your CPNI.
Call Recording and the California Invasion of Privacy Act (CIPA)
MightyCall’s platform includes call recording functionality. Under the California Invasion of Privacy Act (Cal. Penal Code §630 et seq.), it is unlawful to record or eavesdrop upon any confidential telephone communication without the consent of all parties to that communication. This “all-party consent” requirement applies whenever any participant in a call is located in California, regardless of where MightyCall or the customer is based.
Customer obligations. MightyCall provides call recording as a technology tool. The legal responsibility to obtain all required consents before recording any call rests with each MightyCall customer. CIPA §632 requires that all parties to a call be informed that the conversation is being recorded before or at the moment recording begins. A beep tone alone does not constitute sufficient notice under CIPA, because it does not communicate to an uninformed party that recording is occurring. Customers must ensure that the called or calling party receives an explicit verbal announcement — not a beep tone only — before or at the start of any recording involving a California participant.
Inbound calls. For inbound calls, MightyCall’s platform plays a verbal announcement to the caller before the call is connected or recording begins (e.g., “This call may be recorded for quality and training purposes”). This satisfies CIPA §632’s notice requirement for inbound call recording, provided customers use this feature and do not disable or bypass the announcement.
Outbound calls — important limitation. For outbound calls, MightyCall’s current platform plays a beep tone at the start of recording rather than a verbal announcement. A beep tone alone does not satisfy CIPA §632’s notice requirement when any party to the call is located in California. Customers who record outbound calls involving California parties must independently implement a verbal notice before or at the start of recording — for example, by opening the call with a scripted verbal disclosure (“I’d like to let you know that this call may be recorded”) before activating the recording function, or by using a pre-recorded message played to the called party at the moment of connection. Relying solely on the beep tone for outbound calls involving California participants creates material CIPA §632 liability.
Auto-dialers and outbound calling campaigns. Customers using auto-dialers or automated outbound calling campaigns that include call recording face heightened CIPA compliance obligations. Because an auto-dialer initiates calls without a live agent present at the moment of connection, there is no opportunity for a human agent to provide verbal notice before recording begins. For auto-dialed recorded calls involving California parties, customers must use one of the following compliant approaches: (i) play a pre-recorded verbal disclosure message to the called party immediately upon connection and before any substantive conversation or recording begins (e.g., “This call is being recorded. Press 1 to continue or hang up to decline”); (ii) obtain prior written consent from the called party before the call is placed, in a form that clearly discloses that calls will be recorded; or (iii) configure the auto-dialer to connect to a live agent first, who provides verbal notice, before recording is activated. Additionally, auto-dialed calls to California numbers may independently trigger the Telephone Consumer Protection Act (TCPA) and California’s Automatic Dialing-Announcing Device (ADAD) statute (Cal. Pub. Util. Code §2874), which impose separate consent and disclosure requirements. Customers are responsible for ensuring compliance with all applicable laws governing automated outbound calling.
In-platform recording tools. MightyCall’s platform provides a verbal recording announcement for inbound calls and a beep-tone notification for outbound calls. The verbal announcement on inbound calls is designed to assist customers in meeting their CIPA §632 notice obligations. The beep-tone on outbound calls satisfies certain non-California state recording laws (including federal one-party consent rules and the laws of some states that accept a beep-tone as sufficient notice) but does not, on its own, satisfy CIPA for calls involving California parties. Customers recording outbound calls to or from California must supplement the platform’s beep-tone with a verbal disclosure, prior written consent, or another CIPA-compliant method as described above. MightyCall will notify customers of material changes to platform recording notification functionality. Use of MightyCall’s recording tools does not substitute for each customer’s own legal review. Customers who fail to comply with CIPA may face civil liability of up to $5,000 per violation, or three times actual damages, whichever is greater, plus injunctive relief and attorneys’ fees (Cal. Penal Code §637.2).
MightyCall’s own recording practices. MightyCall may record calls made to our customer support and sales lines for quality assurance and training purposes. All parties are notified of recording via an audible announcement at the start of each such call. By continuing a call after this announcement, you consent to the recording.
Data storage for recordings and call data. All permanent data, including contact lists, call records, recordings, and transcripts, are stored in the United States via Microsoft Azure and Amazon Web Services (AWS). MightyCall may also temporarily process Personal Data in other regions for purposes such as technical support, customer support, and sales. Temporary data associated with calls is processed through MightyCall’s Data Centers and may be stored there for no more than 48 hours.
Use of Cookies
MightyCall uses “cookies” to enhance your use of our website. “Cookies” are small text files placed on your computer’s hard drive by a website when you visit that website. These files identify your computer and record your preferences and other data about your visit to a website so that when you return to that site, the site operator knows who you are and can personalize your visit. For example, cookies enable a website shopping cart to function so that you only have to check out once. Consequently, cookies are often tied to the use of personally identifiable information while using our website. If you choose not to accept the use of cookies, your use of our website may be impaired.
Session-replay tools and CIPA §631. California Penal Code §631 prohibits the intentional interception of wire communications without the consent of all parties. MightyCall does not use session-replay software or analytics tools that capture or transmit the substantive content of private communications between website visitors. Behavioral analytics tools we use record interaction metadata such as click patterns and navigation paths; they do not intercept or store message content. Our live chat widget logs the content of support conversations for customer service purposes only; by initiating a chat session on our website you consent to this logging. We do not share the content of chat conversations with third-party advertising networks. You may opt out of non-essential tracking via our Cookie Preference Center, accessible from the footer of our website. We honor the Global Privacy Control (GPC) browser signal as a valid opt-out from the sale or sharing of personal information by California residents.
Cookies allow us to do the following:
Complete transactions you have requested;
Collect information to determine which services and sections of our website are most and least popular;
Personalize our website and make recommendations to you based on services you have used in the past; and
Improve the ease of use of our website, sometimes in conjunction with web beacons.
MightyCall does not use cookies to store credit card information. MightyCall does, however, use cookies to store login information for customers who choose the option of storing such information on their computers.
MightyCall also uses a session-based cookie to maintain continuity of navigation for you when viewing our website during a particular on-line session. After closing the browser, the session cookie simply terminates; it is not stored on your computer’s hard drive thereafter.
MightyCall gathers this data using cookies (both first party cookies, such as the Google Analytics cookie, and third-party cookies, such as the DoubleClick cookie), web beacons, tags, and other similar techniques that deliver small files to your computer and which allow these networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers.
