Terms of Service

1. Acceptance of Terms
By accessing or using UserCheck services ("Services"), you agree to these Terms. If you do not agree, do not use the Services.
Age Requirement: You must be at least 16 years old (or the age of consent in your jurisdiction) to use our Services.
2. Service Description
UserCheck provides an API to identify temporary or disposable email addresses. Our service validates email addresses against our database of disposable domains.
3. Service Plans
We offer three plans:
Free Plan: Limited daily requests, no registration required
Registered Free Plan: Higher monthly limits with registration
Pro Plan: Paid subscription with increased limits

4. Registration and API Keys
Free Plan: No registration required
Registered Plans: You'll receive a confidential API key upon registration
Keep your API key secure - all usage is attributed to your account
5. Acceptable Use
You may not use our Services:
For unlawful purposes
To support spam or fraud
To damage or impair our services
In violation of any applicable laws
6. API Usage and Rate Limiting
We enforce rate limits to ensure fair usage. Exceeding limits may result in temporary or permanent suspension.
7. Payments
Payment Processing
We use Paddle.com Market Limited ("Paddle") as our merchant of record. When you buy a paid plan, your contract for the transaction is with Paddle and you agree to Paddle's Checkout Buyer Terms.
Who charges you: "PADDLE.NET*USERCHECK" (or similar) will appear on your card or bank statement. Paddle issues invoices, collects taxes, and handles refunds or charge‑backs.
Card data: We never receive or store your full payment‑card details; all sensitive payment information is processed directly by Paddle.
Payment Terms
Billing: Paid plans are billed in advance
Refunds: Fees are non-refundable except as required by law or Paddle's buyer terms
Auto-renewal: Subscriptions automatically renew unless canceled via the UserCheck dashboard
8. Security and Service Availability
Data is encrypted in transit via TLS 1.3 and encrypted at rest by our database provider, PlanetScale (SOC 2 Type 2). See our security page for details.
Standard plans. The Service is provided “as-is,” with no guaranteed uptime. We work hard for high availability but do not commit to a specific percentage under these Terms.
Enterprise plans. If you have executed an Enterprise or custom agreement with UserCheck, any separate Service Level Agreement (SLA) contained in that contract will apply instead of the paragraph above.
9. Data Processing
When you submit personal data through our API, you act as the Data Controller and we act as your Data Processor. This relationship is governed by our Data Processing Agreement.
Your obligations:
Have lawful basis for processing
Provide privacy notices to your users
Do not submit sensitive data
10. Intellectual Property
All UserCheck content and software is our property and protected by copyright laws.
11. Limitation of Liability
Our total liability is limited to the fees you paid in the last 12 months. We are not liable for indirect, incidental, or consequential damages.
12. Data Resale and Redistribution
You may not resell, sublicense, share, or redistribute UserCheck data or API results to third parties without our written agreement. This includes incorporating our data into products or services used by others.
13. Data Breach Notification
See Data Processing Agreement Section 6 for our breach notification obligations.
14. Changes to Terms
We may update these Terms at any time by publishing the revised version at usercheck.com/legal/terms. The updated Terms become effective immediately for new users and upon posting for existing users. If you continue using the Service after the update, you accept the new Terms.
For Enterprise customers with a separate written agreement, any change to these public Terms does not modify your signed contract unless expressly stated.
If you do not agree with the updated Terms, your sole remedy is to stop using the Service and cancel your account.
15. Termination
We may suspend or terminate your access for Terms violations or at our discretion.
16. Governing Law
These Terms are governed by Singapore law. Singapore courts have exclusive jurisdiction over any disputes.
