Thank you for choosing to be part of our community at Appiphony, LLC (“Company”, “we”, “us”, or “our”). Appiphony is committed to privacy and data protection. This Privacy Policy describes Appiphony’s privacy practices and how we use personal information we collect from:

Individuals who visit our website to procure our custom software development services or who install our applications (“Appiphony Products”) or purchase them (collectively, "Customers"), and

1. WHEN THIS PRIVACY POLICY APPLIES
When you use and interact with our website or services, or communicate with us, we may collect, use, share and process information relating to you ("Personal Data"). These Privacy Policy summarizes our Personal Data processing practices and your related rights and applies to all Personal Data collected through our website, Customer Portal or through our Appiphony Products, which Customers install in their Salesforce account, and any related services, sales or marketing activities (collectively the “Services.”) Salesforce.com, and its subsidiaries (“Salesforce”) host the Appiphony Products, as well as some of the systems we use to process information we receive from Visitors and individuals with whom we interact through email or other messaging systems. This means that information submitted to our website or Services, and any other information Appiphony receives from you, is stored and maintained in accordance with Salesforce’s Privacy Statement, which can be viewed here: https://www.salesforce.com/company/privacy/full_privacy. Our Privacy Policy does not create any obligation on the part of Salesforce.
2. OTHER WEBSITES AND THIRD PARTY SERVICES
When our Services contain links to other websites, applications, platforms and services maintained by third parties, the information practices of these third parties are governed by their privacy statements, which you should review to better understand their privacy practices. When these offerings are provided by third parties, the privacy statement of the third party applies, and this Privacy Policy does not.
3. WHAT PERSONAL DATA WE COLLECT
Appiphony collects the following Personal Data voluntarily provided to us from Visitors and Customers:
Your first and last name, company name, job title, business email address, location, and information about how you were referred to us and services you might be interested in;
If you purchase our Services, we may collect financial and billing information, such as billing contact name and address (including email address);
If you email us or contact us via our Customer Portal, a messaging service, such as a Slack channel, website form, social media, such as LinkedIn, or a social network, we will keep your message and collect your email address, user name/ID, and contact information;
When you use our website as a Visitor, we may use cookies and other website navigational tools to collect information such as the date and time of your access and your web browser (such as browser type and browser language). For further information on our use of cookies and website navigational tools, please refer to Section 5, “How we use cookies and other tracking technologies;” and
Where you or your company has purchased Services from us and you are designated as a contact, we may collect information including your name, company name, business address, business phone number, job title, business email address and information concerning activities and other services and products you might be interested in.
We may obtain your information from other third-party sources, such as public databases, joint marketing partners, as well as from other third parties. Examples of the information we receive from other sources include: social media profile information (your name, gender, birthday, email, current city, state and country, user identification numbers for your contacts, profile picture URL, and any other information that you choose to make public); marketing leads and search results and links, including paid listings (such as sponsored links).
4. HOW WE USE THE PERSONAL DATA WE COLLECT
Appiphony uses the Personal Data we collect via our website and Services for a variety of business purposes described below. We process your Personal Data for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, and/or for compliance with our legal obligations.
Web registration information, Appiphony Customer Portal information, billing information and email and messaging information
We use web browsers (such as browser type and browser language). We do this using common information-gathering tools, such as cookies.
We use web registration information, and email and messaging information for the legitimate interests of Appiphony, including to provide information to you to promote our products and services.
We use billing information to provide Services in the performance of our contracts and to fulfill and manage your orders and payments.
We use web registration information to demonstrate our Services, host online forums, and populate Visitors’ online profiles. We may use your information to request feedback and to contact you about your use of our Services.
We use information collected about you from third-party sources to combine this information with Personal Data provided by you. This helps us to update, expand and analyze our records, identify new Customers and create more tailored advertising to provide services that may be of interest to you.
Website navigational information
Appiphony uses website navigational information to operate and improve our website. We may also use website navigational information alone or in combination with information collected through web registrations, billing information and email and other social media messaging information to provide personalized information about us and our Services.
Customer Portal
When you participate in our Customer Portal, you are given a username and password to contact us, access our Services and to log cases with our support team. We may use your Personal Data provided to the Customer Portal as follows:
To determine the last time you logged in;
To deliver to you personalized support;
We may review how you engage in the Customer Portal through support cases raised on behalf of your company to help us determine what issues our Customers experience, how our Services are used, which Services and features are used most and least, and the effectiveness of our documentation and other resources;
Displaying personalized advertisements and content
We process your Personal Data, consisting of your IP addresses, name and email, to advertise to you once you have initiated contact with Appiphony and expressed interest in our Services, and in such context, we provide personalized information about us on and off our website, and provide other personalized content based upon your activities and interests, in each case to the extent necessary for our legitimate interest in directly advertising our products and services or, where applicable, to the extent you have provided your prior consent.
Sending marketing communications
We process your Personal Data, consisting of your IP addresses, name and email, to send you marketing information, product recommendations and other non-transactional communications about us and our partners, including information about our products, services and events, once you have initiated contact with Appiphony and expressed interest in our Services, as necessary for our legitimate interest in conducting direct marketing or to the extent you have provided your prior consent.
Legitimate interests of Appiphony
When you visit our website, or use our Appiphony Products, we collect your Personal Data for the legitimate interests of Appiphony. Appiphony may also aggregate your Personal Data with data that you separately provide on social media and third-party websites.
Our legitimate interests include:
Contacting Visitor and Customers to market and advertise products, services and events that we and our partners provide;
Ascertaining the interests and preferences of Visitors and Customers;
Ascertaining what interests Visitors and how Visitors interact with information, materials and other assets on our website;
Determining the most appropriate information, materials and assets to present to Visitors and Customers, and determining the likelihood of their companies to buy; and
Ascertaining what events, training and activities might be of interest to Visitors and Customers;
Responding to legal requests and to prevent harm; and
Protecting our business, assets, property and rights.
We may use and store this information in aggregated and anonymized form so that it is not associated with individual end users and does not include Personal Data. We will not use Personal Data without your consent.
Your rights to object and unsubscribe
You have the right to object to our use of your information by contacting us at privacy@appiphony.com. You may adjust your preferences or choose to unsubscribe from marketing communications at privacy@appiphony.com as well. Please note that, where you or your company has purchased Services from Appiphony and you are designated as a contact, you cannot opt out of receiving transactional emails related to your account or use of the Services.
5. HOW WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES
Appiphony uses cookies and similar tracking technologies to make your interactions on our website easy and meaningful. When you access our website, our servers send a cookie to your computer. Below is a description of the types of cookies we use and when and how you can control their use.

Appiphony engages third-parties to track and analyze non-personally identifiable usage and volume statistical information from individuals who visit our Websites, like Google Analytics for website analytics. You may opt-out of third-party cookies from Google Analytics through their website.
6. HOW WE SHARE YOUR INFORMATION
Appiphony does not share, sell, rent, or trade Personal Data with third parties for their promotional purposes. However, we may share or disclose your Personal Data under the following circumstances:
Your consent
We may share or disclose your information at your specific direction.
Salesforce
We may provide to Salesforce our Customers’ data and information for Salesforce Sales Cloud’s advertising, direct marketing and lead generation.
Google
We may provide to Google our Customers’ data and information to allow Customers to connect to their third-party accounts and for web and mobile analytics.
Vendors, Consultants and other service providers
We may share your Personal Data with third party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: payment processing, data analysis, email delivery, hosting services, customer service and marketing efforts.
Business partners
From time to time, Appiphony may partner with other companies to offer products or services. If you purchase or specifically express interest in a jointly-offered product or service we jointly offer with another company, we may share Personal Data about you collected in connection with your purchase or expression of interest with that other company. We do not control our business partners’ use of your personal information, and their use of the information will be subject to their own privacy policies. If you do not wish your information to be shared in this manner, you must opt not to purchase or specifically express interest in a jointly offered product or service.
Law and harm
Notwithstanding anything to the contrary in this Privacy Policy, we may preserve or disclose your Personal Data if we believe that it is reasonably necessary to comply with a law, regulation or a legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect our rights or property. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s request to disclose your Personal Data , including a government’s request for the same.
Change of control
In the event that Appiphony is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your Personal Data may be sold or transferred as part of that transaction. This Privacy Policy will apply to your Personal Data as transferred to the new entity.
Third parties
Appiphony does not authorize the collection of Personal Data by third parties through advertising technologies deployed on our website, nor do we share Personal Data collected from our website with any third parties, except as provided in this Privacy Policy.
Other users and public and non-personal information
When you share Personal Data (for example, by posting comments, contributions or other content to the Services) or otherwise interact with public areas of the Services, such Personal Data may be viewed by all users and may be publicly distributed outside the Services in perpetuity. If you interact with other users of our Services and register through a social network, your contacts on the social network will see your name, profile photo, and descriptions of your activity. Similarly, other users will be able to view descriptions of your activity, communicate with you within our Services, and view your profile.
EEA, United Kingdom or Switzerland
If you are a resident of the European Economic Area (EEA), United Kingdom or Switzerland, Appiphony will not transfer your Personal Data to any third party except under a contract with the third party that restricts the third party’s access, use and disclosure of Personal Data in compliance with the European Commission’s standard contractual clauses or an alternative mechanism for the transfer of data as approved by the European Commission (Art. 46 GDPR) or other applicable regulators or legislators.
7. INTERNATIONAL TRANSFER OF PERSONAL DATA
Irrespective of which country you reside in or supply information from, you authorize us to use your Personal Data in the United States and any other country where we operate. Your Personal Data may be collected, transferred to and stored by us in the United States and by our affiliates and third-parties that are based in other countries.
Therefore, your Personal Data may be processed outside your country or jurisdiction, including in places that are not subject to an adequacy decision by the European Commission or your local legislature or regulator, and that may not provide for the same level of data protection. We ensure that the recipient of your Personal Data offers an adequate level of protection and security, for instance by entering into the appropriate back-to-back agreements and, if required, standard contractual clauses or an alternative mechanism for the transfer of data as approved by the European Commission (Art. 46 GDPR) or other applicable regulators or legislators. Where required by applicable law, we will only share, transfer or store your Personal Data outside of your jurisdiction with your prior consent.

You may also review our Appiphony Product Data Processing Addendum (“DPA”), which forms part of our Appiphony Product Services Agreement or other written or electronic agreement between Appiphony Product and applicable Customers to legally transfer personal data out of the EU, UK and/or Switzerland and into the U.S. here: https://appiphony.com/legal/appiphony-product-data-processing-addendum. If you are resident in the EEA and you believe we are unlawfully processing your Personal Data, you also have the right to complain to your local data protection supervisory authority. 8. HOW TO ACCESS, CORRECT, UPDATE AND REQUEST DELETION OF YOUR INFORMATION
Retention
Appiphony may retain your Personal Data for a period of time consistent with the original purpose of collection. For instance, we may retain your Personal Data during the time in which you have an account to use our website or Services and for a reasonable period of time afterward. We also may retain your Personal Data during the period of time needed for Appiphony to pursue our legitimate interests, conduct audits, comply with our legal obligations, resolve disputes and enforce our agreements.
Access, correcting, updating and deleting
You may request to access, review, correct, modify or delete any of the Personal Data that you have previously provided to us through our website and Services or that we have otherwise collected about you as described in this Privacy Policy. Please note that when you request us to delete your Personal Data, and Appiphony complies with such request due to there being no other lawful basis to retain such data, Appiphony may retain limited identifying data, such as name, company and email address, in addition to a record of the deletion request, in order to document our compliance with such request, and to prevent future use of such data without another lawful basis.

If you are an individual residing in the EEA, United Kingdom, or Switzerland, you have the following rights for Personal Data processed outside of our Services:
To access your Personal Data held by us (right to access);
To rectify inaccurate Personal Data and, considering the purpose of processing the Personal Data, ensure it is complete (right to rectification);
To erase/delete your Personal Data, to the extent permitted by applicable data protection laws (right to erasure; right to be forgotten);
To restrict our processing of your Personal Data, to the extent permitted by law (right to restriction of processing);
To transfer your Personal Data to another controller, to the extent possible (right to data portability);
To object to any processing of your Personal Data carried out on the basis of our legitimate interests (right to object). Where we process your Personal Data for direct marketing purposes or share it with third parties for their own direct marketing purposes, you can exercise your right to object at any time to such processing without having to provide any specific reason for such objection;
Not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects ("Automated Decision-Making"). Automated Decision-Making currently does not take place on our websites or in our services; and
To the extent we base the collection, processing and sharing of your Personal Data on your consent, to withdraw your consent at any time, without affecting the lawfulness of the processing based on such consent before its withdrawal.
As described above, we may also process Personal Data submitted by or for a Customer to our Services. If not stated otherwise in this Privacy Policy or in a separate disclosure, we process such data in the role of a mere processor or service provider on behalf of a Customer (and/or its affiliates), who is the responsible controller or owner of the Personal Data concerned. We are not responsible for and have no control over the privacy and data security practices of our Customers, which may differ from those set forth in this Privacy Statement.
9. DATA SECURITY
We take precautions including technical, organizational and physical measures to help safeguard against the accidental or unlawful destruction, loss, alteration and unauthorized disclosure of, or access to, the Personal Data we process. However, no method of storage or transmission is 100% secure. You are solely responsible for protecting your password, limiting access to your devices and signing out of websites after your sessions. If you have any questions about the security of our website or Appiphony Products, please contact us at privacy@appiphony.com. Appiphony uses robust security measures to protect your Personal Data from unauthorized access, to maintain data accuracy, and to help ensure the appropriate use of your Personal Data. Please contact us immediately at privacy@appiphony.com if you have reason to believe that your interaction with us is no longer secure.
Data Breach
A data breach occurs when there is unauthorized access to or collection, use, disclosure or disposal of Personal Data. You will be notified about data breaches when Appiphony believes you are likely to be at risk for serious harm. In the event that Appiphony becomes aware of a data breach which has resulted or may result in unauthorized access, use or disclosure of Personal Data, Appiphony will promptly investigate the matter and notify the applicable supervisory authority not later than 72 hours after having become aware of it, unless the data breach is unlikely to result in a risk to the rights and freedoms of natural person.
10. USAGE METRICS, ANALYTICS AND APPIPHONY PRODUCTS
In addition to information gathered through the other media described in this Privacy Policy, Appiphony through its Appiphony Products may obtain information through 1) the Salesforce mobile application that our Customers or their authorized individual users download to, and run on, their mobile devices or through 2) Customer’s browser when Customer is logged on to Salesforce.
The Salesforce mobile application may provide Appiphony Product information from, or access data stored on, users’ devices to provide services related to the Appiphony Product. For example, an Appiphony Product may access a camera on a user’s device to enable the user to upload photographs to our Services. An Appiphony Product may transmit information to and from devices to provide the Appiphony Product service.
The Appiphony Product may provide us with information related to Customer’s use of the Appiphony Product Service, information regarding Customer’s computer systems, mobile device and browser, which we may use to provide and improve the Appiphony Product. For example, all actions taken in the Appiphony Product may be logged, along with associated information (such as the time of day when each action was taken). We may also share anonymous data about these actions with third party providers of analytics services. In addition, if a user downloads the Appiphony App after clicking on a third-party advertisement for the application or for Appiphony, the third-party advertiser may provide us with information, such as the user’s device identification information, which we may use to track the performance of our advertising campaigns.
Customers may configure Appiphony Product, and the information accessed or obtained by the Appiphony Product, in a Customer’s Salesforce or third party service account, which may be affected by the Customer’s configuration. In addition, the Appiphony Product are designed to interoperate with other services; for instance, to provide a user with access to information from the Salesforce and third party services.
Notices and contractual terms related to a particular application, including Appiphony Product, may be found in the subscription agreement or relevant terms of service for that application. We encourage you to review the end user license agreement or relevant terms of service related to any applications you download, install, use, or otherwise interact with.
11. POLICY TOWARDS CHILDREN
Our website and Services are not directed at children. We do not knowingly collect Personal Data from children under the age of 13. We do not knowingly collect Personal Data for children between 13-18 unless we have obtained consent from a parent or guardian or such collection is subject to a separate agreement with us or the visit by a child is unsolicited or incidental. If you believe we have mistakenly or unintentionally collected Personal Data of a minor without appropriate consent please contact us at privacy@appiphony.com and we will take steps to delete their Personal Data from our systems.
12. CHANGES TO PRIVACY POLICY
We will update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, and other factors. If we do, we will update the “effective date” at the bottom of this Privacy Policy. The most current version of the Privacy Policy will govern our use of your information and will always be at https://appiphony.com/legal. If we make a material update, we may provide you with notice prior to the update taking effect, such as by posting a notice on our website or by contacting you directly, or where required under applicable law and feasible, seek your consent to these changes. We encourage you to periodically review this Privacy Policy to stay informed about our collection, processing and sharing of your Personal Data.
13. CALIFORNIA CONSUMER PRIVACY ACT (CCPA)
The California Consumer Privacy Act (as amended by the California Privacy Rights Act) requires certain businesses to disclose whether they sell or share Personal Data. CCPA does not apply to Appiphony based on revenue, and the number of California resident users or devices from which we collect data. Appiphony does not “sell” personal information as defined under the California Consumer Privacy Act.
14. CALIFORNIA RESIDENTS AND “SHINE THE LIGHT”
If you are a resident of California, you are granted specific rights regarding access to your Personal Data. California Civil Code Section 1798.83, also known as the “Shine the Light” law, permits our Visitors and Customers who are California residents to request and obtain from us, once a year and free of charge, information about categories of Personal Data (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared Personal Data in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request to us at privacy@appiphony.com
15. HOW LONG WE KEEP YOUR PERSONAL DATA
We may retain your Personal Data for a period of time consistent with the original purpose of collection. We determine the appropriate retention period for Personal Data on the basis of the amount, nature and sensitivity of your Personal Data processed, the potential risk of harm from unauthorized use or disclosure of your Personal Data and whether we can achieve the purposes of the processing through other means, as well as on the basis of applicable legal requirements (such as applicable statutes of limitation).
After expiry of the applicable retention periods, your Personal Data will be deleted. If there is any data that we are unable, for technical reasons, to delete entirely from our systems, we will put in place appropriate measures to prevent any further use of such data.
