Please include your name, email address, and / or telephone number and clearly describe the complaint you have. We will acknowledge and respond to your compliant within a reasonable time period. If you think we have not resolved your complaint satisfactorily, you can refer the matter to the Office of the Australian Information Commissioner. Revisions to this Privacy Policy Any personal information that is collected via our Services is covered by the Privacy Policy in effect at the time such personal information is collected. We may modify and revise this Privacy Policy from time to time. If we make any material changes to this Privacy Policy, we’ll notify you of those changes by posting them on the Services or by sending you an email or other notification, and we’ll update the “Last Updated� date above to indicate when those changes will become effective. How Do We Collect Personal Information? As further described below, when you use or otherwise access the Services, we may collect personal information in multiple ways, including when you provide personal information directly to us, when we passively collect personal information from your browser or device while using the Services, and when we collect personal information about you from third parties. In some cases, you may decline to provide us with personal information. However, this will limit your ability to register for an Account or use our Services. Personal Information You Provide Directly to Us: Registration Information. We may collect personal information you provide when you create an Account or Campaign or enter a promotion. This information may include your first name and last name, mailing address, date of birth, email address, and username. Communications with Tiltify. We may collect personal information from you such as email address, phone number, or mailing address when you request information about our Services, sign up for our newsletter, register for an event, request customer or technical support, or otherwise communicate with us. Transaction Information. We may collect information related to any transactions you initiate on the Services, for example, when you create a Campaign or make a Contribution to a Cause or a Campaign Owner. Customer Service and Support. If you call or otherwise interact with Tiltify’s customer service and support, we may collect the information you provide to our representatives. In addition, we may record telephone calls between you and our representatives for training and quality assurance purposes. Interactive Features. We may offer interactive features such as livestreams, commenting functionalities, forums, chat and messaging services, and social media pages. Tiltify and other individuals who use our Services may collect the information you submit or make available through these interactive features. Any information shared on the public sections of these channels will be considered “public� and may not be subject to the privacy protections referenced herein. Please be considerate and respectful of others while using Tiltify’s interactive features. We reserve the right, but do not have the obligation, to review and monitor such postings or any other content on our Services, and to remove postings or content that may be viewed as inappropriate or offensive to others. Conferences, Trade Shows, and other Events. We may attend or host conferences, trade shows, and other events where we collect personal information from individuals who interact with or express an interest in Tiltify and/or the Services. If you provide us with any information at one of these events, we will use it for the purposes for which it was collected. Surveys. We may contact you to participate in surveys. If you decide to participate, you may be asked to provide certain information which may include personal information. Registration for Sweepstakes and Contests. We may run sweepstakes and contests. Contact information you provide may be used to reach you about the sweepstakes or contest and for other promotional, marketing and business purposes, if permitted by law. In some jurisdictions, we are required to publicly share information of winners. Business Development and Strategic Partnerships. We may collect personal information from individuals and third parties to assess and pursue potential business opportunities. Job Applications.If you apply for a job with us, we will collect any personal information you provide in connection with your application, such as your contact information and CV. Personal Information We Collect Through Your Use of the Services. We may collect certain personal information automatically when you, or any person(s) you authorize through your Account, use the Services. This information may include your Internet protocol (IP) address, user settings, IMEI, MAC address, Technologies including cookie identifiers, mobile advertising and other unique identifiers, mobile carrier, details about your browser, operating system or device, location information (including inferred location based off your IP address), Internet service provider, pages that you visit before, during, and after using the Services, information about the links you click, the content you view or post, your preferences, how often you use the Services, and other information about how you use the Services. Personal information we collect may be associated with your Account and the devices you use. Cookies, Web Beacons, and Personalized Advertising. We, as well as third parties that provide content, advertising, or other functionality on the Services, may use cookies, pixel tags, local storage, and other technologies (“Technologies�) to automatically collect personal information through the Services. Technologies are essentially small data files placed on your computer, tablet, mobile phone, or other devices that allow us and our partners to record certain pieces of information whenever you visit or interact with the Services. Cookies. Cookies are small text files placed in visitors’ device browsers to store their preferences. Most browsers allow you to block and delete cookies. However, if you do that, the Services may not work properly. Pixel Tags/Web Beacons. A pixel tag (also known as a web beacon) is a piece of code embedded on the Services that collects information about users’ engagement on that web page. The use of a pixel allows us to record, for example, that a user has visited a particular web page or clicked on a particular advertisement. We may also include web beacons in e-mails to understand whether messages have been opened, acted on, or forwarded. Analytics. We use Google Analytics, a service provided by Google, Inc. We may obtain personal information about you from third parties, including through Third-Party Services (defined below) and other organizations. For example, if you create an Account or otherwise use the Services using your login credentials from a Third-Party Service such as Facebook, Twitter, Twitch, and Google (each, a “Third-party Account�), we may collect information about you from that Third-party Account that you have made available via your privacy settings including, but not limited to, your name, email address, preferences, donation amount, and other comments. In addition, Campaign Sponsors and Account holders may upload or otherwise provide personal information about others. How Do We Use Personal Information? We process personal information for a variety of business purposes, including: To Provide the Services or Information Requested. To fulfill our contract with you; Manage your account and information; Process your payment card and/or other financial information to facilitate your use of the Services; Respond to questions, comments, and other requests; Provide access to certain areas, functionalities, and features of our Services; and Answer requests for customer or technical support. Administrative Purposes. Pursue our legitimate interests, such as direct marketing, research and development (including marketing research), network and information security, and fraud prevention; Measure interest and engagement in the Services; Improve our products and Services; Develop new products and services; Ensure internal quality control and safety; Verify individual identity; Carry out audits; Communicate with you about your Account, activities on the Services and changes to our agreements; Prevent and prosecute potentially prohibited or illegal activities; Enforce our Terms of Service; and Comply with our legal obligations. Marketing Our Services. We may use personal information to tailor and provide you with content and advertisements. We may provide you with these materials as permitted by applicable law. Some of the ways we market to you include email campaigns and “interest-based� or “personalized advertising.� If you have any questions about our marketing practices or if you would like to opt out of the use of your personal information for marketing purposes, you may contact us at any time as set forth below. De-identified and Aggregated Information Use. We may use personal information and other information about you to create de-identified and/or aggregated information, such as de-identified demographic information, de-identified location information, de-identified or aggregated trends, reports, or statistics, or other analyses we create. De-identified and aggregated information is not personal information, and we may use and disclose such information in a number of ways, including research, internal analysis, analytics, and any other legally permissible purposes. Sharing Content with Friends or Colleagues. Our Services may offer various tools and functionalities. For example, we may allow you to provide information about your friends through our referral services. Our referral services may allow you to forward or share certain content with a friend or colleague, such as an email inviting your friend to use our Services. Technologies. Our uses of such Technologies fall into the following general categories: Operationally Necessary. This includes Technologies that allow you access to our Services that are required to identify irregular behavior, prevent fraudulent activity and improve security or that allow you to make use of our functions; Performance Related. We may use Technologies to assess the performance of our Services, including as part of our analytic practices to help us understand how our visitors use the Services; Functionality Related. We may use Technologies that allow us to offer you enhanced functionality when accessing or using our Services. This may include identifying you when you sign into our Services and keeping track of your specified preferences, interests, or past pages viewed; Analytics Related. We may use Technologies to collect and understand analytics about our Services. Advertising or Targeting Related. We may use first-party or third-party Technologies to develop and deliver content, including ads relevant to your interests, on our Services or on third-party sites. Consent. Tiltify may use personal information for other purposes that are clearly disclosed to you at the time you provide personal information or with your consent. Personal Information We Share with Third Parties We may share the personal information that we have collected as described below: Services Providers. We may engage third party services providers to work with us to administer and provide the Services. Payment Processor. If you make or receive a Contribution through our Services, such payment is handled by our third-party payment processor (each, a “Payment Processor�). Non-limiting examples of Payment Processors include PayPal and Stripe. Any information that you provide on or to a Payment Processor or that is collected by a Payment Processor is provided directly to the owner or operator of the Payment Processor and is subject to the owner’s or operator’s privacy policy. Payment Processors are Third-Party Services. We’re not responsible for the content, privacy or security practices and policies of any Payment Processors. To protect your information, we recommend that you carefully review the privacy policies of all Payment Processors that you utilize. APIs and Software Development Kits. We may use third party APIs and software development kits (“SDKs�) as part of the functionality of our Services. For more information about our use of APIs and SDKs, please contact us as set forth below. Disclosures to the Blockchain. Aspects of the Services may be hosted on or interact with the blockchain. Where you use aspects of the Services that are hosted on or interact with the blockchain, information about your interactions and/or transactions will be provided to the applicable blockchain network and may be accessible to third parties due to the nature of the blockchain protocol. Advertising Partners. We may share your personal information with third-party advertising partners. These third-party advertising partners may set Technologies and other tracking tools on our Services to collect information regarding your activities and your device (e.g., your IP address, cookie identifiers, page(s) visited, location, time of day). These advertising partners may use this information (and similar information collected from other services) for purposes of delivering personalized advertisements to you when you visit digital properties within their networks. This practice is commonly referred to as “interest-based advertising� or “personalized advertising.� Disclosed in Connection with Business Transactions. Information that we collect from our users, including personal information, is considered to be a business asset. Thus, if we are acquired by a third party as a result of a transaction such as a merger, acquisition or asset sale, or if our assets are acquired by a third party in the event we go out of business or enter bankruptcy, some or all of our assets, including your personal information, may be disclosed or transferred to a third-party acquirer in connection with the transaction. Information Disclosed for Our Protection and the Protection of Others. We cooperate with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate: (i) to respond to claims, legal process (including subpoenas); (ii) to protect our property, rights and safety and the property, rights and safety of a third party or the public in general; and (iii) to stop any activity that we consider illegal, unethical or legally actionable activity. PPGF Campaigns. For some Campaigns, the donation page will disclose that donations will not go directly to the Cause Owner, but rather to PayPal Giving Fund (“PPGF�) , a Donor Advised Fund (DAF) recognized by the Internal Revenue Service (IRS) under Section 501(c)(3) of the Code in the US, and a registered charity in the other jurisdictions where it operates to support a designated Cause Owner. PayPal Giving Fund's use of these details is subject to its Privacy Policy (https://www.paypal.com/us/webapps/mpp/givingfund/policies/privacy-policy). Where donors opt in to share their details with the benefitting charities) this information will be shared with those charities to use under the terms of the PayPal Giving Fund user agreement (https://www.paypal.com/us/webapps/mpp/givingfund/policies/nonprofit-user-agreement). Personal Information You Choose to Share As indicated above, this Privacy Policy explains our practices regarding the collection, use and disclosure of personal information that we receive when you use our Services. Our Services also enable you to share information, including information about yourself. Sharing Personal Information in Connection with the use of our Services. If you are an Account holder, you will have a profile page on the Services. For certain information, you can choose what information you wish to share in your profile via the Account Settings page of your Account, although certain information, such as your Tiltify username, will always be public. If you are a Cause Owner, Campaign Owner, or Campaign Sponsor, the online Cause or Campaign pages you publish will be publicly available on the Internet. There are no private or hidden Tiltify Cause Pages or Campaign pages. Your activity is public. If you make a Contribution, you will have the option to publicly display your support, including your name, the amount of your Contribution and a message of support. Alternatively, you will be able to label your donation as “Anonymous� but still show the amount of your Contribution and a message of support, by clicking the “Anonymous� checkbox during the Contribution process. Note that the total amount of Contributions received for a Cause or Campaign will be publicly available and so any Contribution you make will be included in this figure. When you make a Contribution, the following information is always shared with the Cause Owner: your username (and your display name if you’ve chosen one), your email address, the amount of your Contribution, any comments you’ve included, and whether or not you have elected that the Cause Owner and/or the Campaign Owner can contact you regarding your Contribution. If you elected for the Campaign Owner to be able to contact you, they will receive your email address. If your submission involves rewards and you have elected to receive those rewards, any information necessary to send you those rewards will also be sent to the Cause Owner and/or the Campaign Owner (such as your email address, mailing address and requested clothing sizes). Regardless whether you choose to make your donation “Anonymous� to the public, your information will be shared with the benefiting Cause Owner to enable the Cause Owner to acknowledge your contribution and recognize your donations for its tax records. Some Cause Owners and/or the Campaign Owner may have additional requirements, such as being logged in to participate in events (necessitating registration) and other additional mandatory information for making contributions. Cause Owners, Campaign Owners, and Campaign Sponsors may both request you provide information needed to distribute rewards to you, such as your shipping address and clothing sizes. Cause Owners and Campaign Owners are required by Tiltify to use any of the above collected information solely for (i) sending you rewards; (ii) sending you promotional communications (if you elect to receive them); and (iii) for the Cause Owner’s and/or Campaign Owner’s internal audit or tax reporting purposes. Campaign Sponsors may use your shipping information only to send you rewards. While Tiltify requires this limited use of information by the Cause Owners, Campaign Owner’s, and Campaign Sponsors, Tiltify is not responsible to you for any Cause Owner’s, Campaign Owner’s, and/or Campaign Sponsor’s misuse of your information. Third-Party Services You Share or Interact With. The Services may link to or allow you to interface, interact, share information with, direct us to share information with, access and/or use third-party websites, applications, services, products, and technology (each a “Third-Party Service�). For example, you may be able to make a Contribution using DAFpay provided by Chariot Giving, Inc. Any personal information shared with a Third-Party Service will be subject to the Third- Party Service’s privacy policy. We are not responsible for the processing of personal information by Third-Party Services. Your Choices General. The privacy choices you may have about your personal information are determined by applicable law and are described below. Email Communications. If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email. Note that you will continue to receive transaction-related emails regarding the Services you have requested. We may also send you certain non-promotional communications regarding us and our Services, and you will not be able to opt out of those communications (e.g., communications regarding the Services or updates to our agreements). Email Communications from Cause Owners. When you make a Contribution with the check-box checked for allowing the Cause Owner to contact you, that Cause Owner may subsequently contact you to thank you for your donation or to send you other communications. To opt out of such communications, you must contact the Cause Owner directly; we do not handle opt-out requests on behalf of Cause Owners. Technologies and Personalized Advertising. If you would like to opt-out of certain Technologies we employ on the Services, you may do so by clicking here or by blocking, disabling, or deleting them as your browser or device permits. Please note that cookie-based opt-outs are not effective on mobile applications. However, you may opt-out of personalized advertisements on some mobile applications by following the instructions forAndroid, iOS, and others. http://www.youronlinechoices.eu/ The online advertising industry also provides websites from which you may opt-out of receiving targeted ads from advertisers that participate in self-regulatory programs. You can access these, and also learn more about targeted advertising and consumer choice and privacy, by visiting the Network Advertising Initiative, the Digital Advertising Alliance,the European Digital Advertising Alliance, and the Digital Advertising Alliance of Canada. Please note you must separately opt out in each browser and on each device. Do Not Track. Our Services do not have the capability to respond to “Do Not Track� signals received from various web browsers. Individual Rights in Personal Information In accordance with applicable law, you may have the right to: Confirm Whether We Are Processing Your Personal Information; Request Access to or Portability of Your Personal Information; Request Correction of Your Personal Information; Request Deletion of Your Personal Information; Request Restriction of or Object to our Processing of Your Personal Information; and Withdraw Your Consent to our Processing of Your Personal Information. Please note that your withdrawal will only take effect for future processing, and will not affect the lawfulness of processing before the withdrawal. If you would like to exercise any of these rights, please contact us as set forth below. We will process such requests in accordance with applicable laws. To protect your privacy, Tiltify will take steps to verify your identity before fulfilling your request. Retention of Personal Information We store the personal information we receive as described in this Privacy Policy for as long as you use our Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws. To determine the appropriate retention period for personal information, we may consider applicable legal requirements, the amount, nature, and sensitivity of the personal information, certain risk factors, the purposes for which we process your personal information, and whether we can achieve those purposes through other means. International Transfers of Personal Information Your personal information may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you’re located outside the United States and choose to provide your personal information to us, we may transfer your personal information to the United States and process it there. If we transfer personal information which originates in the European Economic Area, Switzerland, and/or the United Kingdom to a country that has not been found to provide an adequate level of protection under applicable data protection laws, one of the safeguards we may use to support such transfer is the EU Standard Contractual Clauses. Supplemental Notice for EU/UK GDPR This Supplemental Notice for EU/UK GDPR only applies to our processing of personal information that is subject to the EU or UK General Data Protection Regulation. In some cases, providing personal information may be a requirement under applicable law, a contractual requirement, or a requirement necessary to enter into a contract. Tiltify’s processing of your personal information may be supported by one or more of the following lawful bases: Performance of a Contract: Tiltify may need to process personal information to perform the contract we have with you. Legitimate Interest: Tiltify may process personal information to further our legitimate interests, but only where our interests are not overridden by your interests or fundamental rights and freedoms. Consent: In some cases, Tiltify may also rely on your consent to process personal information. Compliance with Legal Obligations: Tiltify may process your personal information to comply with our legal obligations. Children’s Information The Services are not directed to children under 13 (or other age as required by local law), and we do not knowingly collect personal information from children. Supervisory Authority Australia.
