1. Agreement
These Terms of Service ("Terms") govern your use of the Send360 platform (the "Services"). By using the Services, you agree to these Terms.
2. Services Description
Send360 provides a marketing automation platform that enables businesses to manage and execute personalized marketing campaigns integrated with enterprise systems such as CRM platforms.
3. Customer Responsibilities
Customers agree to:
Provide accurate and lawful data
Obtain all necessary consents for marketing communications
Use the Services in compliance with applicable laws (e.g., CAN-SPAM, GDPR, CCPA)
4. Data Ownership
Customers retain all rights, title, and interest in Customer Data.
Send360 does not claim ownership of Customer Data.
5. Acceptable Use
Customers may not:
Use the Services for unlawful or abusive purposes
Transmit harmful code or attempt to breach security
Use the platform to send spam in violation of laws
6. Confidentiality
Both parties agree to maintain confidentiality of non-public information. We will treat Customer Data as confidential and use it only to provide the Services.
7. Data Processing
We process Customer Data solely to provide the Services, in accordance with our Privacy Policy and applicable agreements.
8. Term and Termination
These Terms remain in effect while you use the Services.
Either party may terminate per contractual agreement.
Upon termination, data will be deleted within 30 days, unless otherwise agreed in writing.
9. Subprocessors
We may use third-party subprocessors to deliver the Services. A current list will be made available upon request.
10. Disclaimers
The Services are provided "as is" and "as available." We disclaim all warranties to the fullest extent permitted by law.
11. Limitation of Liability
To the maximum extent permitted by law, Send360 shall not be liable for indirect, incidental, or consequential damages.
12. Indemnification
Customers agree to indemnify and hold harmless Send360 from claims arising from their use of the Services or violation of these Terms.
13. Governing Law
These Terms shall be governed by the laws of the state of California, USA.
14. Changes to Terms
We may update these Terms from time to time. Continued use of the Services constitutes acceptance of updated Terms.
