Terms and Conditions
Last updated: 9 August 2026
Gauss is a professional clinical information and practice-support platform for licensed healthcare professionals. It is an aid to research, documentation and organisation. It does not practise medicine, does not diagnose, and never replaces the independent clinical judgement of the treating professional.
1. Acceptance of these terms
These Terms and Conditions ("Terms") form a binding agreement between you and Gauss ("Gauss", "we", "us") governing your access to and use of the Gauss website, web application, mobile experience, embedded integrations and related services (together, the "Service"). By creating an account, signing in through a hospital or software partner, or otherwise using the Service, you accept these Terms. If you do not accept them, you must not use the Service.
If you use the Service on behalf of a clinic, hospital, network or other organisation, you confirm that you are authorised to bind that organisation, and "you" includes it.
2. Who may use the Service
The Service is intended exclusively for licensed physicians, veterinarians and other regulated healthcare professionals, and for the administrative staff acting under their supervision. It is not intended for patients, for consumers, or for self-diagnosis or self-treatment. You must be at least 18 years old.
You confirm that the professional credentials, licence numbers, specialty and institutional affiliation you provide are accurate, current, and that your licence is in good standing. We may verify these details, and may suspend or refuse access where verification fails or where the Service is used outside its intended professional scope.
3. Accounts, access and security
Accounts are personal and must not be shared. You are responsible for all activity under your account, for keeping your credentials, magic links, security PIN and trusted devices confidential, and for notifying us without delay of any suspected unauthorised access.
Access may be granted by invitation, through a professional network, through a clinic or hospital administrator, or through single sign-on from a partner clinical software vendor. Where your access is provisioned by an organisation, that organisation may enable or disable individual modules, may add or remove users, and may lose or regain access to the Service as a whole; your access follows theirs.
4. Beta and evolving features
Parts of the Service are offered in beta or as previews. Beta features are provided as they are, may change, may be limited by usage quotas, and may be withdrawn at any time without liability. They are not suitable to be relied upon as the sole basis for any clinical, operational or financial decision.
5. Nature of the Service — no medical advice, no medical device
The Service provides information retrieval, summarisation, drafting, scheduling and record-organisation support. It does not provide medical advice, does not establish a doctor–patient relationship between you and Gauss, and is not intended to be used as a medical device, nor for diagnosis, prevention, monitoring, prediction, prognosis or treatment of disease.
Outputs — including literature summaries, answers to clinical questions, drug and interaction information, differentials, suggested next steps, consultation notes, transcriptions, image commentary and voice analyses — are informational drafts for a qualified professional to review. They may be incomplete, out of date, or incorrect. You remain solely and fully responsible for every clinical decision, prescription, documentation entry and communication you make, and you must independently verify any information before acting on it, including against the official product labelling, applicable guidelines and your own examination of the patient.
Where the Service presents conditions to "consider ruling out", ranked or grouped material, or similar framing, this is a research aid ordered by relevance to the text you submitted. It is not a probability, a risk score, or a recommendation.
6. Automated processing and generated content
The Service uses automated processing, including natural-language and machine-learning techniques, to search, translate, transcribe, summarise and draft content. Generated content is produced statistically and can contain errors, omissions, invented references or misleading confidence. Citations and links are provided so that you can verify the underlying source; the source, not our summary, governs.
We select, combine and change the underlying technical providers and processing methods at our discretion in order to improve quality, availability, cost and compliance, without notice and without any commitment to any particular technical implementation. Nothing in the Service should be read as a warranty about how a given output was produced.
Third-party databases, registries, literature indexes, trial registries, labelling sources and other external references are surfaced for convenience. We do not control them, do not endorse them, and are not responsible for their content, accuracy, availability or licensing terms.
7. Patient data and your responsibilities as controller
Some features let you enter, import, dictate, upload or generate information relating to identified or identifiable patients, including consultation notes, clinical files, scheduling data, identifiers, documents, images, audio recordings and connected wearable measurements.
As between you and Gauss, you (or your organisation) are the controller of that personal data and we act as processor on your documented instructions. You are responsible for having a lawful basis for the processing, for informing patients, for obtaining any consent required for recording, transcription or data sharing, for respecting professional secrecy, and for the accuracy of what you enter. You must not upload personal data you are not entitled to process, and you should avoid uploading identifying data where it is not necessary for the task.
We process personal data in accordance with the General Data Protection Regulation and applicable national health-data rules, as described in our Privacy Policy and, where applicable, in a data processing agreement with your organisation. We apply technical and organisational safeguards including access control, role-based permissions, encryption in transit and at rest, and audit logging. No safeguard is absolute.
8. Your content and licence to operate the Service
You keep all rights in the content you submit. You grant us a limited, worldwide, royalty-free licence to host, store, transmit, process, display and adapt that content strictly as needed to operate, secure, support and improve the Service for you and, where applicable, for your organisation.
We do not sell your content. We do not use identifiable patient data to train general-purpose models. We may use aggregated and de-identified statistics that cannot reasonably be linked to a person to measure usage, quality and reliability.
9. Acceptable use
You must not:
use the Service to deliver care outside your licence, jurisdiction or competence;
present generated output to patients or third parties as if it were verified clinical advice;
upload content you have no right to upload, or data belonging to patients who are not yours;
attempt to re-identify de-identified data, or circumvent access controls, PIN gates, quotas or feature restrictions;
scrape, bulk-extract, resell, sublicense or white-label the Service or its outputs without written permission;
reverse engineer, probe or interfere with the Service, or use it to build a competing product;
upload malicious code, or use the Service unlawfully, deceptively or abusively.
We may suspend access immediately where we reasonably believe these rules are being broken or where patient safety, security or legal compliance is at risk.
10. Integrations, partners and networks
The Service can connect to clinical software vendors, scheduling providers, messaging and email providers, wearable-data providers and other third-party systems, including through single sign-on and embedded views. Your use of those systems is governed by their own terms. We are not responsible for their acts, omissions, availability, or for data you choose to send to or receive from them.
Where your access is provided through a network, clinic or vendor, the administrator of that entity may see usage information relating to their users, manage members, configure templates and communications, and enable or disable modules.
11. Communications
The Service sends operational messages — invitations, sign-in links, appointment confirmations, reminders, cancellations, rescheduling notices and follow-ups — to you, to your staff and, where you configure it, to your patients. You are responsible for the content of templates you edit, for the accuracy of recipient details, and for obtaining any consent required for those messages. Recipients can unsubscribe from non-essential messages; transactional and security messages cannot be switched off while an account is active.
12. Intellectual property
The Service, including its software, design, interfaces, prompts, templates, workflows, branding and documentation, is owned by Gauss or its licensors and is protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your professional practice while these Terms are in force. All other rights are reserved. Feedback you send us may be used freely, without obligation or compensation.
13. Fees
Access may be free, discounted, invitation-based or subject to subscription or usage fees agreed with you or your organisation. Where fees apply, they are stated at the point of purchase or in your written agreement, are exclusive of taxes unless stated, and are non-refundable except where required by law. We may change pricing prospectively with reasonable notice.
14. Availability and changes
We aim for a reliable Service but do not guarantee uninterrupted availability. Maintenance, upgrades, third-party outages and force majeure events may interrupt access. We may add, modify, restrict or discontinue features, including where necessary for safety, security, legal or regulatory reasons.
15. Disclaimer of warranties
To the fullest extent permitted by law, the Service and all outputs are provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any warranty of accuracy, completeness, currency, clinical suitability, merchantability, fitness for a particular purpose, non-infringement, or that outputs are free from error or bias. Nothing in these Terms excludes rights that cannot be excluded under mandatory law.
16. Limitation of liability
To the fullest extent permitted by law, Gauss is not liable for any indirect, incidental, special, consequential or punitive damages, nor for loss of profits, revenue, goodwill, data, or for any clinical outcome, diagnosis, treatment decision, missed finding, documentation error or regulatory sanction arising from your use of, or reliance on, the Service. Our total aggregate liability for all claims in any twelve-month period is limited to the greater of the amounts you paid us for the Service in that period or EUR 100.
Nothing here limits liability for fraud, wilful misconduct, gross negligence, or death or personal injury caused by our negligence, where such limitation is not permitted by law.
17. Indemnity
You will indemnify and hold Gauss harmless against claims, damages, penalties and reasonable costs arising from your breach of these Terms, your unlawful or unauthorised processing of personal data, your professional acts or omissions, or content you submit to the Service.
18. Suspension and termination
You may stop using the Service and request deletion of your account at any time. We may suspend or terminate access for breach of these Terms, for security or safety reasons, on instruction of the organisation that provisioned your access, or where we discontinue the Service. On termination, your right to use the Service ends. We will make patient and clinical records reasonably available for export for a limited period, after which data may be deleted, except where retention is required by law or by the controller's own retention obligations.
19. Governing law and disputes
These Terms are governed by the laws of Portugal, excluding its conflict-of-law rules. The courts of Lisbon, Portugal, have exclusive jurisdiction, subject to any mandatory consumer or professional protections available to you locally. Mandatory local health, professional-secrecy and data-protection rules continue to apply wherever you practise.
20. Changes to these Terms
We may update these Terms to reflect changes in the Service, in law or in our practices. Material changes will be notified in the Service or by email. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service.
21. General
If a provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganisation or transfer of business. These Terms, together with the Privacy Policy and any written agreement with your organisation, form the entire agreement between us; in case of conflict, a signed written agreement prevails.
22. Contact
Questions about these Terms, data protection requests or notices of suspected misuse can be sent to legal@docbay.com.
