1. Who we are
DFX5 Corp. ("DFX5", "we", "us", "our") is a Florida corporation headquartered at 888 Biscayne Blvd, Unit 208, Miami, FL 33132, United States. We are an AWS Premier Consulting Partner delivering enterprise AI, Amazon Connect Customer, and cloud modernization services to financial services and enterprise clients across Latin America, the Caribbean, and the Southeastern United States.
DFX5 is also a Meta Tech Provider for the WhatsApp Business Platform. In that capacity, we provide software and integration services that enable our business clients to communicate with their own customers over WhatsApp. Section 11 of this policy describes how we handle data received from the WhatsApp Business Platform.
2. Scope of this policy
This policy applies to:
Visitors to dfx5.com and our other websites and marketing pages.
Prospective and current clients of DFX5's professional services and software products.
Personal data that our clients direct us to process on their behalf, including data received from the Meta WhatsApp Business Platform ("Platform Data").
This policy does not cover the privacy practices of our clients. When you interact with a DFX5 client on WhatsApp or any other channel our software powers, that client is the controller of your data and their privacy policy applies to how they use it.
3. Definitions
Client — a business, organization, or public-sector entity that engages DFX5 for services or software.
End User — an individual customer of a Client who interacts with the Client through software or services provided by DFX5.
Platform Data — any information or data DFX5 receives from Meta Platforms, Inc. or its affiliates in connection with the WhatsApp Business Platform, including message content, phone numbers, message templates, delivery status, quality signals, and WhatsApp Business Account metadata.
Personal data — any information relating to an identified or identifiable natural person.
4. Information we collect
4.1 From website visitors
When you visit dfx5.com or submit a form, we collect: your name, email address, company, role, and the content of your message; IP address, browser type, device information, referring URL, and pages viewed; cookie identifiers and analytics data (see Section 10).
4.2 From Clients and Client personnel
When you engage DFX5 as a Client, we collect: business contact information, authentication credentials for services you authorize us to access on your behalf, billing information, and records of the services we deliver.
4.3 Platform Data from the WhatsApp Business Platform
When a Client authorizes DFX5 to act on their behalf as a WhatsApp Tech Provider, we receive Platform Data from Meta in order to deliver the service. This includes: End User phone numbers, message content sent and received, message templates the Client submits, delivery and read status, quality ratings, and WhatsApp Business Account and phone number metadata.
Platform Data is processed on behalf of the Client. The Client is the controller of Platform Data relating to their End Users; DFX5 is a processor acting on the Client's documented instructions.
5. How we use information
5.1 Website visitor and Client data
We use this information to respond to inquiries, deliver contracted services, maintain and improve our websites and products, secure our systems, invoice Clients, and comply with legal obligations.
5.2 Platform Data
We use Platform Data solely to provide contracted services to the Client that owns it. Permitted uses include:
Sending messages to End Users on the Client's behalf (for example: appointment reminders, payment notifications, service alerts, and other communications the Client has configured).
Receiving replies from End Users and routing them to the Client's agents, systems, or automated responses.
Submitting, reviewing, and managing WhatsApp message templates for the Client's approval.
Monitoring message quality and delivery so the Client remains in good standing with Meta.
Providing support to the Client, including troubleshooting message delivery issues.
5.3 What we do not do with Platform Data
DFX5 does not:
Use Platform Data for advertising or marketing purposes, whether our own or a third party's.
Sell, license, rent, or otherwise share Platform Data with third parties, except sub-processors necessary to provide the service (see Section 7).
Combine Platform Data across Clients.
Use Platform Data to build profiles for purposes unrelated to the Client's use case.
Retain Platform Data longer than required to deliver the service or comply with law.
6. Legal bases (EU/UK GDPR)
Where GDPR applies, we rely on the following legal bases: performance of a contract (delivering services to Clients and prospective Clients), legitimate interests (securing our systems, improving our services, direct marketing to business contacts), consent (analytics cookies where required, marketing emails to individuals), and legal obligation (tax, accounting, and legally-required disclosures).
For Platform Data processed on behalf of a Client, the Client is responsible for establishing the legal basis for their communication with End Users.
7. Sharing and sub-processors
We share information with:
AWS (Amazon Web Services) — infrastructure, storage, compute, Amazon Connect Customer, Amazon Bedrock, and related services. AWS is DFX5's primary infrastructure sub-processor.
Meta Platforms — for messages sent and received through the WhatsApp Business Platform, as required to deliver the service.
Business communication and productivity providers — email, calendar, video conferencing, and CRM platforms used to run the business.
Professional advisors — accountants, auditors, and legal counsel, under confidentiality obligations.
Government authorities — where required by law, subpoena, or valid legal process.
A current list of material sub-processors is available on request to privacy@dfx5.com.
We do not sell personal data or Platform Data.
8. International data transfers
DFX5 operates from the United States and maintains delivery resources in Colombia, Mexico, Peru, Argentina, India, Pakistan, Slovakia, the Czech Republic, Puerto Rico, and the Dominican Republic. Personal data and Platform Data may be accessed by authorized DFX5 personnel in these locations to deliver contracted services.
Where required by law, we implement appropriate safeguards for cross-border transfers, including the European Commission's Standard Contractual Clauses and equivalent mechanisms. Sub-processors are contractually bound to equivalent protections.
9. Data retention and security
Retention. We retain website inquiry data for up to 24 months from last contact. We retain Client records for the duration of the engagement and for up to 7 years afterward for legal, tax, and audit purposes. Platform Data is retained only as long as required to deliver the service to the Client; upon Client offboarding or written request, Platform Data is deleted within 30 days, except where retention is required by law.
Security. Data is hosted on AWS infrastructure with encryption in transit (TLS 1.2 or higher) and at rest (AES-256 or equivalent). We enforce least-privilege access controls, multi-factor authentication for personnel, audit logging, and periodic security reviews. We follow the AWS Well-Architected Framework Security Pillar for services we operate.
10. Cookies and tracking
dfx5.com uses cookies and similar technologies for: essential site functionality, analytics (Google Analytics via Google Tag Manager), and measuring the effectiveness of our marketing. Where required by law, we present a cookie consent banner and honor your choices. You can also manage cookies through your browser settings; disabling non-essential cookies will not prevent you from using the site.
11. WhatsApp Business Platform — additional commitments
In our capacity as a Meta Tech Provider, DFX5 commits to the following in addition to the general terms of this policy:
We handle Platform Data in accordance with the Meta Platform Terms, WhatsApp Business Solution Terms, and the WhatsApp Business Messaging Policy.
We act only on the documented instructions of the Client whose WhatsApp Business Account we manage.
We do not use Platform Data to advertise or market to End Users on our own behalf.
We do not use Platform Data to make eligibility decisions, credit decisions, or automated decisions with legal or similarly significant effects on End Users, unless expressly instructed by the Client and permitted by law.
We enable Clients to submit data deletion requests and to offboard from our platform without unreasonable barriers.
We report data incidents affecting Platform Data to Meta and to affected Clients without undue delay.
If you are an End User who received a WhatsApp message powered by DFX5's platform on behalf of one of our Clients, please contact that Client directly for data requests. If you are unsure which Client sent the message, contact us at privacy@dfx5.com and we will help route your request.
12. Your rights
Depending on your location, you may have the right to:
Access — request a copy of personal data we hold about you.
Rectify — correct inaccurate or incomplete data.
Delete — request deletion, subject to legal retention obligations.
Restrict or object — limit or object to certain uses of your data.
Portability — receive your data in a portable format.
Withdraw consent — where processing is based on consent.
Not be subject to discrimination — for exercising your rights (California residents).
Opt out of sale or sharing — DFX5 does not sell personal data.
Lodge a complaint — with a supervisory authority in your jurisdiction.
To exercise these rights, email privacy@dfx5.com. We will respond within the timeframes required by applicable law (generally 30 to 45 days). We may need to verify your identity before fulfilling requests.
For a full description of the data deletion process, see https://dfx5.com/data-deletion.
13. Children's privacy
DFX5's services are not directed to children. We do not knowingly collect personal data from individuals under the age of 13, or under 16 in jurisdictions where that is the minimum age of digital consent. WhatsApp itself requires users to be at least 13 years old. If you believe a child has provided us with personal data, contact privacy@dfx5.com and we will delete it.
14. Changes to this policy
We may update this policy from time to time. Material changes will be announced on this page with an updated "Last updated" date. For material changes affecting Platform Data or Client obligations, we will provide advance notice to Clients as required by contract.
