Arbitration shall be conducted by a mutually agreed-upon arbitrator under the rules of the American Arbitration Association (AAA) in Vero Beach, Florida, or via remote hearing where feasible. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. YOU AND CLOUD LATITUDE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. 12. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
