Terms of Service

1. Interpretation
Words with capitalized initial letters have meanings defined under these Terms. The following definitions apply regardless of whether they appear in singular or plural form.
2. Definitions
For the purposes of these Terms and Conditions:
"Affiliate" means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities that entitle such owner to elect directors or other managing authority.
"Country" means Japan.
"Company" (also referred to as "We," "Us," or "Our") means Aokumo Inc., with its official address at 1-11-1 Marunouchi, 13F Pacific Century Place Marunouchi, Chiyoda-ku, Tokyo, 100-6208, Japan.
"Device" means any device capable of accessing the Service, including but not limited to computers, mobile phones, tablets, and smart devices.
"Service" means the Website, mobile applications, software, APIs, AI-powered services, and all other digital or online services provided by the Company, including but not limited to Aokumo AI and its related products.
"Terms and Conditions" (also referred to as "Terms") means these provisions that form the entire agreement between You and the Company regarding the use of the Service.
"Third-Party Social Media Service" means any services or content (including data, information, products, or services) provided by a third party that may be displayed, included, or made available by the Service.
"Website" means aokumo.io and aokumo.ai, accessible at https://www.aokumo.io and https://www.aokumo.ai, respectively.
"You" means the individual accessing or using the Service, or the company or legal entity on whose behalf such individual is accessing or using the Service.
3. Acknowledgment
By accessing or using the Service, You acknowledge and agree that:
These Terms and Conditions govern Your use of the Service and form a binding agreement between You and the Company.

Reverse-engineer, decompile, or attempt to extract the source code of the Service.
Use automated systems, including bots or scrapers, to extract data from the Service without Our written permission.
Transmit any malicious software, viruses, worms, or any other harmful code.
Engage in fraudulent activities, impersonation, or misrepresentation.
Upload or share any content that is illegal, abusive, defamatory, obscene, or otherwise objectionable.
Violate any third-party rights, including intellectual property rights, privacy rights, or contractual obligations.
Violations of these provisions may result in immediate termination of Your access to the Service and potential legal action.
5. Intellectual Property
The Service, including aokumo.io and aokumo.ai, and its original content, features, and functionality remain the exclusive property of the Company and its licensors.
The Service is protected by copyright, trademark, and other laws in Japan and other applicable jurisdictions.
You may not use Our trademarks, trade names, or logos without Our prior written consent.
6. Your Feedback to Us
By submitting any suggestions, ideas, or feedback ("Feedback") to the Company, You grant the Company a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, modify, distribute, and incorporate such Feedback into the Service without restriction.
You acknowledge that providing Feedback does not entitle You to compensation, ownership, or any rights in the Service.
7. Links to Third-Party Websites
The Service may contain links to third-party websites or services that are not owned or controlled by the Company.
The Company is not responsible for the content, privacy policies, or practices of any third-party websites.
We encourage You to read the terms and policies of any third-party sites You visit.
8. Termination
We may suspend or terminate Your access to any part of the Service, including aokumo.io and aokumo.ai, immediately, without prior notice or liability, for any reason, including but not limited to:

Misuse of the Service
Security threats or fraudulent activities
Upon termination, Your right to use the Service ceases immediately.
9. Limitation of Liability
The Company's total liability for any damages You may incur shall be limited to the amount You actually paid for the Service or 100 USD if no payment was made.
To the maximum extent permitted by law, the Company shall not be liable for:Indirect, incidental, special, or consequential damagesBusiness interruptions, loss of data, or lost profitsAny reliance on third-party content or services
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so these provisions may not fully apply to You.
10. "As Is" and "As Available" Disclaimer
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not guarantee:
That the Service will be uninterrupted or error-free
That the Service will meet Your expectations or requirements
That any errors or security issues will be corrected
You assume full responsibility for Your use of the Service.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed under the laws of Japan, excluding conflict of law principles.
Any dispute arising from or related to these Terms shall be resolved through binding arbitration in Tokyo, Japan, in accordance with the rules of the Japan Commercial Arbitration Association (JCAA).
If arbitration is not permitted by law, disputes shall be resolved in the courts of Tokyo, Japan.
12. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in effect to the maximum extent permitted by law.
13. Waiver
Failure to enforce any provision of these Terms shall not be considered a waiver of Our rights to enforce such provision in the future.
