Please read these Terms carefully. By creating an account, purchasing a subscription, or using Pana Events or Pana Olai, you agree to be legally bound by these Terms.
2.1 Key Disclosures
These Terms cover two products: Pana Events (for organisations, provided after a demo) and Pana Olai (for individuals, available by direct sign-up). Both are delivered through one mobile app and our websites.
You must be at least 16 years old, or the age of majority or digital consent in your jurisdiction if higher, to use either product.
Pana Olai and Pana Events subscriptions are paid and renewed automatically until cancelled. There is no free trial for Pana Olai whereas Pana Events has 14 day free trial.
Subscription fees are non-refundable, except as set out in our Refund Policy or where the law requires a refund. Cancelling stops your next renewal, and you keep access until the end of the period you have paid for.
You are responsible for having the rights, permissions, notices or consents needed to capture information about other people, including their contact details, business cards, event badges, photographs and all other details.
You can dictate notes with voice-to-text. Pana does not store the audio.
AI-generated content may be inaccurate or incomplete. You must review it before relying on it.
We may update these Terms with 30 days' notice for material changes. Continued use after that notice means you accept the changes.
Our liability is limited to the fees you paid in the 12 months before the claim.
These Terms are governed by Delaware law, and disputes go to binding arbitration, subject to any consumer protection laws that cannot be waived in your country.
2.2 About Pana, Pana Events and Pana Olai
MathiVerse, Inc. ("Pana", "we", "us", "our") is a Delaware corporation, Pana Events and Pana Olai are products within the Pana suite of business software. These Terms govern Pana Events and Pana Olai only. Other Pana products are governed by their own terms.
Pana Events is a cloud-based Software-as-a-Service platform for organisations. It provides AI event discovery, mobile lead capture (badge scanning, QR codes, business card scanning), event expense tracking and ROI measurement, AI-powered pre-event signals, email campaign tools, team collaboration, meetup creation, an event directory, voice-to-text notes, and CRM, email, LinkedIn and calendar integrations.
Pana Olai is a digital business card and lead capture product for individual users. It provides digital business cards, contact and lead capture (including business card and badge scanning), voice-to-text notes, lead qualification and categorization, reminders and follow-ups, and a Google Calendar integration.
In these terms:
"Services" means Pana Events, Pana Olai, our websites, mobile applications (iOS and Android), APIs and related services.
"Individual Account" means a Pana Olai account created and owned by an individual.
"Workspace" means a Pana Events account set up for an organization, which administrators manage and members access by invitation.
"Your Content" means data, information and materials you upload, create, capture or record through the Services.
"Contact Data" means personal information about other people that you capture through the Services, such as event attendees, prospects and the people you speak with.
“Consumer” means an individual who uses the Services wholly or mainly for purposes outside their trade, business or profession, or anyone treated as a consumer under the consumer protection law that applies to them.
2.3 Acceptance and Changes to These Terms
By registering for an account, clicking "I agree", purchasing a subscription, or using the Services, you agree to these Terms. If you use Pana Events on behalf of an organisation, you agree on behalf of yourself and that organisation. If you lack authority to bind your organisation, do not use Pana Events.
These Terms incorporate our Privacy Policy (Section 1) and Cookie Policy. For Pana Events, any signed Order Form, purchase order acceptance or Data Processing Agreement also forms part of the agreement. If an Order Form conflicts with these Terms, the Order Form governs for that customer.
We may amend these Terms at any time. For material amendments, we will give 30 days' notice by email or in-app notification. Continued use after the notice period means you accept the amended Terms. If you disagree, you may cancel your subscription under Section 2.7.
2.4 Eligibility and Accounts
You must be at least 16 years old, or the age of majority, or have digital consent in your jurisdiction if that is higher.
If you use Pana Events, you must be legally authorised to act for your organisation.
You must provide accurate, current and complete registration information and keep it up to date.
You are responsible for keeping your login credentials confidential and for all activity under your account.
Notify us immediately at [email protected] if you discover unauthorized access to your account.
Accounts are personal and may not be transferred without our written consent.
We may refuse registration or suspend or terminate accounts in our reasonable discretion and in line with Section 2.7.
2.5 Account Types and Ownership
Pana Olai (Individual Accounts). You can create a Pana Olai account directly through the mobile app or our website. Your individual account belongs to you. You control the contacts, leads, notes, tasks, and other content in it, subject to these terms.
Pana Events (Workspaces). Pana Events accounts are not available by self-sign-up. A workspace is set up for an organization after a demo and purchase. Workspace administrators invite members and set their permissions. Events, leads, expenses, budgets, assets, notes, demo bookings, reports, and other records created in a Workspace belong to that Workspace. Members who leave a workspace may lose access to its records.
Moving from Pana Olai to Pana Events. Pana Olai and Pana Events are separate products with separate accounts and subscriptions. To use Pana Events, contact [email protected], sign up for Pana Events separately, and purchase a Pana Events plan. Once your Pana Events Workspace is active, you can choose to migrate your Pana Olai data into the Workspace or keep your Pana Olai account and Pana Events account separate. We migrate data only at your request. Once migrated, that data becomes workspace content. The workspace administrator and authorized members can access it, and it is governed by your organization's settings and agreement with us. It may stay in the workspace if you later leave.
You may keep your Pana Olai Individual Account alongside your Workspace membership. Your individual account remains yours and continues under these terms and your Olai subscription. Buying Pana Events does not cancel your Pana Olai subscription; cancel it separately if you no longer need it.
Private by default. Events and records in Pana Events and Pana Olai are private to the account or workspace. Pana does not operate a public social network or ticketing platform. Your content is not visible to unrelated users unless you or your workspace owner share it, for example, through a digital business card, an external link, or an integration.
2.6 Subscriptions, Billing, and Payments
No free trial for Pana Olai. Pana Olai has no free trial. Access starts when you purchase a paid plan.
14 day free trial for Pana Events. Billing will start once the trial period is over.
Pana Olai
Plans. Pana Olai is offered on monthly and yearly subscription plans. Current prices are published at pricing and may differ by country and currency.
Where you can pay. You can buy a Pana Olai subscription through our website (payments processed by Stripe, Inc.), through the Apple App Store, or through Google Play.
Auto-renewal. Your subscription renews automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date.
App store purchases. If you buy through the Apple App Store or Google Play, Apple or Google processes the payment. Their terms govern billing, renewal, cancellation, and refunds for that purchase. You must manage or cancel that subscription in your Apple or Google account settings.
Web purchases. If you buy on our website, you agree to Stripe's terms and privacy policy. We do not store full card numbers or CVV data.
Credits. Your Pana Olai plan includes a monthly allowance of credits, used for actions such as business card scanning, badge scanning and contact enrichment. You can buy extra credits in the app (through the Apple App Store or Google Play) or on our website. Credits have no cash value and cannot be transferred, sold or exchanged for money.
Pana Events
How you buy. Pana Events is purchased after a demo. Your organization places an order by purchase order or order form, and we send a Stripe payment link for each invoice.
Plans and pricing. Plan, seats, add-ons, billing frequency, and price are set out in your order form. Pana Events is not sold through the Apple App Store or Google Play.
Payment terms. Invoices are payable by the date stated on the invoice or order form. We may suspend access if payment is overdue after giving notice.
Credits. Pana Events does not provide any credits rollover. Unused credits are deleted at the end of every month. Purchased credit packs expire 12 months from the date of purchase. Credits have no cash value and cannot be transferred, sold or exchanged for money.
Pana Events and Pana Olai
Price changes. We may change prices with at least 30 days' notice to existing subscribers. The new price applies from your next renewal. App-store price changes follow Apple's or Google's notice and consent processes.
Taxes. Stated prices exclude applicable taxes, including VAT, GST, and sales tax, unless stated otherwise. You are responsible for applicable taxes. Where required by law, Pana, Apple, or Google will collect and remit taxes.
Refunds. For monthly subscription plans, if you cancel a plan bought directly from us, we do not refund any part of the current month’s Pana Olai subscription. In the case of annual plans, please send an email to [email protected], and on a case-to-case basis, the Pana team will consider a refund. This does not guarantee a refund to your plan. Duplicate charges, charges made after cancellation, extended service failures, and discontinued products are eligible for a refund. Refunds for App Store or Google Play purchases must be requested from Apple or Google under their policies. Full details are in our Refund Policy.
Pricing errors. If a plan is shown or charged at the wrong price because of an obvious error, we may correct the price, cancel the affected purchase, and refund any amount paid. We will tell you before we do this. App Store and Google Play purchases follow Apple’s or Google’s processes.
Credits are non-refundable. All credits, whether included in a plan or bought as extra credits, are non-refundable once purchased, including when you cancel or delete your account. The only exceptions are duplicate or mistaken charges, as described in our Refund Policy, or where the law requires a refund. Unused credits are removed when your subscription ends.
2.7 Cancellation, Suspension, and Termination
Cancellation by you. You may cancel your subscription at any time for Pana Olai via Google Play or App Store, and for Pana Events by contacting your Workspace administrator, or if you are the administrator, follow the billing cancellation flow on your Workspace. App Store and Google Play subscriptions stay active until the end of the period you paid Apple or Google for.
Pana Olai web subscriptions: cancel in your account settings or by contacting [email protected].
Pana Olai App Store or Google Play subscriptions: cancel in your Apple or Google account settings.
Pana Events: cancel as set out in your Order Form, or by contacting [email protected].
Deleting your account is not the same as cancelling. Deleting a Pana Olai account does not cancel an App Store or Google Play subscription. Cancel it through Apple or Google to stop future charges.
Suspension or termination by Pana. We may suspend or terminate your account if:
You breach these terms and do not fix the breach within 7 days of our notice;
We reasonably suspect fraud, abuse, unlawful recording, or other illegal activity
We are required by law, a court order, or a regulator;
Payment is overdue after notice; or
We need to fix a technical issue, such as a duplicate account.
Where a breach risks harm to other people, to the Services or to Pana, we may suspend access immediately while we investigate.
Discontinuing the Services. We may discontinue Pana Olai, Pana Events, or a feature with at least 30 days' notice. If we discontinue a product you have prepaid for, we will refund the unused portion of prepaid fees bought directly from us. App-store purchases are refunded under Apple's or Google's policies.
Effect of termination. When your account ends, your license to use the services ends immediately. We handle your data as described in Section 2.13 and the Privacy Policy. Refunds follow our Refund Policy, which allows us to refuse a refund where an account is terminated for breach.
2.8 License and Acceptable Use
License. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-sublicensable, non-transferable, revocable license to use the Services during your subscription. Pana Events is licensed for your organization's internal business purposes. Pana Olai is licensed for your own professional networking, lead management, and related personal business use.
You must not:
copy, modify, distribute, sell, sublicense, or create derivative works from the Services without our prior written consent;
reverse engineer, decompile, or attempt to derive the source code of the services;
Use bots, scrapers, or automated tools to access or extract data from the services
record, transcribe, or capture any person's voice, conversation, image, or personal information where doing so is unlawful or without a required notice or consent;
Record people covertly, or keep recording after a person has asked you to stop where the law requires you to stop;
Capture or upload information about children through the services;
upload special categories of sensitive data about other people (such as health, financial account, government ID, or biometric data) unless you have a lawful basis and it is necessary for a legitimate purpose
send spam or unsolicited commercial messages, conduct phishing, or engage in deceptive practices;
sell, rent, or broker contact data captured through the services, or use it for purposes the person would not reasonably expect;
collect, process, or share personal information without a lawful basis under applicable privacy law;
harass, stalk, defame, threaten, or harm any person;
introduce malware or malicious code, or try to gain unauthorized access to the services or their infrastructure;
Use AI features to generate unlawful, misleading, or harmful content, or present AI output as verified fact without review;
use the services in any way that could damage, disable, or impair their security or availability; or
violate any applicable local, national, or international law or regulation.
use the Services, or any information obtained from them, to build, train or improve a competing product or service, or to benchmark or analyse the Services for competitive purposes, without our written consent;
2.9 Your Content and Information About Other People
You own your content. You grant Pana a limited, non-exclusive license to host, store, process, transmit, and display Your Content solely to provide, secure, and support the Services. Except as described in this Section, we will not use Your Content for any other purpose without your consent.
Aggregated and de-identified data. We may create aggregated or de-identified data from your use of the Services and from Your Content, in a form that does not identify you, your organisation or any individual. We may use this data to operate, analyse, secure and improve the Services and to develop new features. We will not use your notes or Contact Data in identifiable form for these purposes, and we will not use Your Content to train AI models without your consent.
Your content may include information about other people, including:
contact and lead details you enter or capture, such as names, email addresses, phone numbers, job titles, and companies;
information extracted from business cards, event badges, ID cards, and QR codes you scan;
photographs and images you upload;
notes about your interactions, including notes you dictate with voice-to-text;;
lead qualifications, categories, tags, tasks, reminders, and follow-up records; and
in Pana Events, attendee lists, expense records, demo bookings, and other Workspace records.
You are solely responsible for your content, including its accuracy and legality, and for how you use the contact data you capture. You must have the rights and lawful basis to upload, capture, and process it. We may remove content or suspend accounts that violate the law, other people's rights, or these Terms.
Reporting content. If you believe content in the Services infringes your rights, includes your personal information without a lawful basis, or otherwise breaches these Terms, email [email protected]. Describe the content, why you are reporting it and where it appears. We will review your report in good faith and act as appropriate under these Terms and applicable law. Because accounts and Workspaces are private, we may first refer you to the account holder who captured the content.
2.10 Consent and Recording Responsibilities
You are responsible for ensuring that you have the appropriate rights, permissions, notices, or consents required to collect, record, store, process, or use information about other individuals through Pana Events and Pana Olai, including contact information, business card information, event badge information, photographs, audio recordings, conversations, and other personal information.
In particular:
Voice-to-text. Voice-to-text is for dictating your own notes.
Privacy notices. Where the law requires it, you must tell people that you are capturing their information, why, and how they can contact you about it.
Lawful use. You must use Contact Data only for legitimate purposes that the person would reasonably expect, such as following up on a conversation you had with them.
Requests from other people. If someone asks you to access, correct, or delete information you captured about them, you are responsible for responding as required by law. You can do this by editing or deleting the record in your account.
Pana provides tools, not legal advice. The services do not obtain consent on your behalf, and you should not assume that a feature being available means using it is lawful in your situation. You agree to indemnify Pana for claims arising from your failure to meet these responsibilities (Section 2.20).
2.11 Voice, Transcription, and AI Features
Voice-to-text. You can dictate notes using voice-to-text. Your speech is processed in real time only to convert it into text. Pana does not store the audio. The text note is stored in your account until you delete it or your account is deleted.
AI features. The Services use AI for features such as contact enrichment and lead capture in Pana Olai and, in Pana Events, AI event discovery, pre-event signals, AI contact enrichment and lead capture. These features are provided by Pana together with third-party AI providers.
AI limitations: AI output is generated automatically and may be inaccurate, incomplete, out of date, or inappropriate. In particular:
You must review AI Output before relying on it, sharing it, or acting on it. You are responsible for decisions you make using AI Output. Pana does not make decisions about the people in your contacts.
No sensitive decisions. You must not use AI Output to make decisions about employment, credit, insurance, housing, healthcare, or other matters with legal or similarly significant effects on a person.
Model training. We do not use your content or notes to train AI models without your consent.
Availability. AI features may change, be limited by usage caps or credits, or be unavailable at times. Their availability may depend on third-party providers.
2.12 Data, Privacy and DPA
Our Privacy Policy (Section 1) explains how we collect, use and protect personal information, and forms part of these Terms.
Pana Olai. For Contact Data you capture in your Individual Account, you decide why and how it is used, and you are responsible for that use under applicable law. Pana processes it to provide the Services to you.
Pana Events. For Contact Data captured in a Workspace, the customer organisation is the data controller and Pana is the data processor or service provider. The customer is responsible for having a lawful basis, giving privacy notices and complying with data protection law.
DPA. Pana Events customers may request our standard Data Processing Agreement at [email protected]. It includes Standard Contractual Clauses for international transfers where applicable.
2.13 Data Retention, Deletion and Access
Deleting records. You can delete individual contacts, leads, notes, tasks and other records in your account at any time. Deleted records are removed from live systems and may persist in backups for up to 30 days.
Deleting your account. You can delete your Pana Olai account in the app through the account-deletion page on the mobile app or by emailing [email protected]. Pana Events Workspace accounts are closed by the Workspace administrator or under the Order Form.
After your account ends. We retain account data for 90 days after deletion or termination, then delete it, unless we must keep it longer for legal, tax, security, fraud-prevention or dispute reasons. Payment records may be kept for up to 7 years. Data migrated into a Pana Events Workspace is governed by that Workspace's retention, not your Individual Account.
Export. Pana Olai allows you to export your contact data as a CSV file or the QR code of your digital business card(s) as a PNG file in your mobile gallery. Pana Events customers may request an export of Workspace data during the subscription and within 90 days after termination. Requests to access or receive a copy of your personal data under applicable privacy law can be made at [email protected], as described in the Privacy Policy.
Backups. You are responsible for keeping your own copies of information that matters to you.
2.14 Third-Party Services and Providers
The Services rely on and connect with third parties, including:
Service providers that help us run the Services, such as Vercel and Railway for hosting, Stripe for web payments, Apple and Google for app-store payments, third-party AI and speech-processing providers, contact enrichment providers, analytics, email delivery and customer support tools.
Contact enrichment. Where the Services offer enrichment, we use identifiers you provide, such as a name, email address or company, to retrieve professional information from third-party data providers (“Enrichment Data”). Enrichment Data comes from those providers, not from Your Content, and may be inaccurate or out of date. We grant you a limited, non-exclusive, non-transferable, revocable licence to use Enrichment Data for your own internal business purposes during your subscription. You must not sell, publish, redistribute or bulk-export Enrichment Data, or use it to build a competing database.
Integrations you choose to connect. Pana Olai integrates with Google Calendar. Pana Events integrates with services such as HubSpot, Salesforce, Pipedrive, Zoho, Calendly, Google, Outlook, Attio, WhatsApp, LinkedIn, Microsoft, Slack.
Your use of an integration is also subject to that third party's terms and privacy policy. Pana is not responsible for the availability, accuracy, security or practices of third-party services.
2.15 Mobile Application
Pana Events and Pana Olai are delivered through one mobile app. What you can access depends on your account type, plan and Workspace permissions. You can sign up for Pana Olai in the app. Pana Events access requires an invitation to a Workspace.
Some features need device permissions, such as camera, microphone and notifications. You control these permissions in your device settings. If you turn a permission off, related features may not work.
Contact records you create by scanning or manual entry are not imported from your device's address book. If you grant contacts permission, it is used only to save a contact you select to your device.
If you downloaded the app from the Apple App Store or Google Play, you also agree to that store's terms. Apple and Google are not parties to these Terms and are not responsible for the app or its support.
App store terms. If you downloaded the app from the Apple App Store, the following also applies:
These Terms are between you and Pana only, not Apple. Pana, not Apple, is solely responsible for the app and its content.
Your licence to use the iOS app is limited to Apple-branded devices that you own or control, as permitted by the App Store’s usage rules.
Apple has no obligation to provide maintenance or support for the app.
If the app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
Pana, not Apple, is responsible for addressing any claims relating to the app or your use of it. This includes product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
If a third party claims that the app or your use of it infringes their intellectual property rights, Pana, not Apple, is responsible for investigating, defending, settling and discharging that claim.
You confirm that you are not located in a country subject to a US Government embargo, or designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
You must comply with any third-party terms that apply when using the app, such as your mobile data agreement.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple may enforce them against you.
Questions, complaints or claims about the app go to Pana at [email protected].
If you downloaded the app from Google Play, you also agree to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app.
2.16 Changes to the Services
We continually improve the Services. We may add, change or remove features, change plan contents, or change usage limits. If a change materially reduces the core functionality of a plan you have paid for, we will give reasonable notice where practical, and you may cancel under Section 2.7.
If we increase the price of your plan, or make a change that materially and adversely affects your use of the Services, you may cancel before the change takes effect. The new price or change will not apply to the period you have already paid for.
2.17 Intellectual Property
The Services and all related software, technology, interfaces, trademarks, trade names, service marks and content are the exclusive property of MathiVerse, Inc. or its licensors. These Terms do not transfer any intellectual property rights to you.
You own Your Content. As between you and Pana, you also own AI Output generated from Your Content, to the extent the law allows, subject to the rights of any third parties in the underlying content. Enrichment Data is not Your Content or AI Output, and is covered by Section 2.14.
If you send us feedback or suggestions, we may use them without restriction or payment to you.
2.18 Warranties and Disclaimers
We warrant that we have the right to enter into these Terms, that the Services will materially conform to their documentation, and that we will use commercially reasonable efforts to maintain their availability, security and performance.
EXCEPT AS EXPRESSLY SET OUT ABOVE, THE SERVICES AND ALL AI OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF VIRUSES, OR THAT ANY INSIGHT OR LEAD QUALIFICATION WILL BE ACCURATE OR COMPLETE.
2.19 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
PANA'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER OR IN CONNECTION WITH THESE TERMS SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO PANA (OR, FOR APP-STORE PURCHASES, THROUGH APPLE OR GOOGLE FOR THE SERVICES) IN THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM.
IN NO EVENT SHALL PANA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THEIR POSSIBILITY.
PANA SHALL NOT BE LIABLE FOR: (A) DATA LOSS OR CORRUPTION; (B) FAILURES OF THIRD-PARTY SERVICES OR PROVIDERS; (C) ERRORS IN AI OUTPUT OR DECISIONS MADE IN RELIANCE ON IT; (D) YOUR FAILURE TO OBTAIN REQUIRED CONSENTS OR GIVE REQUIRED NOTICES; OR (E) FORCE MAJEURE EVENTS.
Some jurisdictions do not allow these exclusions or limitations. In those jurisdictions, our liability is limited to the greatest extent the law permits, and nothing in these Terms limits rights you have as a consumer that cannot be waived. The limitations in this Section 2.19 limit Pana’s liability only. They do not limit your indemnity obligations under Section 2.20.
2.20 Indemnification
You agree to defend, indemnify and hold harmless MathiVerse, Inc. and its officers, directors, employees, contractors and agents from any claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys' fees) arising from:
your violation of these Terms;
your collection, recording or processing of Contact Data, voice or conversations without the required rights, notices, consents or lawful basis;
Your Content;
your violation of any third party's rights; or
your violation of applicable law.
your indemnity obligations under item 2 are not limited by any other limitation in these Terms. This includes claims, fines and penalties brought by regulators or the people you recorded or captured. These obligations survive termination of your account or subscription.
2.21 Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles.
Informal resolution first. Any dispute must first be raised with us at [email protected]. We will try to resolve it informally within 30 days.
Arbitration. If it is not resolved, the dispute will be decided by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules, with the seat in Delaware. Class actions and class arbitrations are waived to the maximum extent permitted by law.
Exceptions. Either party may seek urgent injunctive relief from a competent court to prevent irreparable harm pending arbitration.
International users. If you live in the EU, UK, India or another jurisdiction whose mandatory consumer protection laws cannot be waived by contract, those laws apply to you in addition to this section. Nothing in this section removes your right to complain to a data protection or consumer authority.
2.22 General
Entire agreement. These Terms, the Privacy Policy, the Cookie Policy and any applicable Order Form or DPA are the entire agreement between you and Pana about the Services.
Severability. If any provision is unenforceable, the rest continue in full force.
Waiver. Failing to enforce a provision is not a waiver of it.
Assignment. You may not assign your rights without our written consent. Pana may assign its rights, including in a merger, acquisition or sale of assets.
Force majeure. Neither party is liable for failure to perform due to causes beyond its reasonable control.
Notices. We may send notices by email to your account address or in the app.
Survival. Sections that by their nature should continue after your account or subscription ends will survive, including Sections 2.9, 2.10, 2.13, 2.14 (Enrichment Data), 2.17, 2.18, 2.19, 2.20, 2.21 and 2.22, together with any payment obligations that arose before termination.
